The Shaykh : So what is it? It is the action of Aisha (may Allah be pleased with her). Aisha (may Allah be pleased with her)
She came with the Prophet (peace and blessings be upon him) during the Farewell Pilgrimage in the state of ihram for 'Umrah. Then menstruation overtook her on the way at Saraf. The Prophet (peace and blessings be upon him) came to her while she was crying and said: "What is wrong with you? Did you have your period?" She said: "Yes." He said: "This is something Allah has decreed for the daughters of Adam." Then he ordered her to enter the state of ihram for Hajj.
, and when she entered the state of ihram for Hajj in this condition, she became one performing Qiran, meaning combining Hajj and 'Umrah, and she did
And he said to her: "Do what the pilgrim does for Hajj, except do not circumambulate the House." وقال لها افعلي ما يفعل الحج غير أن لا تطوفي بالبيت
. But when the Hajj was completed, she said:
O Messenger of Allah, how will the people depart with Hajj and 'Umrah, while I depart with only Hajj? So he ordered her brother 'Abd al-Rahman to take her to al-Tan'im, and she entered the state of ihram for 'Umrah from there. يا رسول الله كيف ينطلق الناس بحج وعمرة وأنطلق بحج فأمر أخاها عبد الرحمن أن يذهب بها إلى التنعيم وتحرم منه بعمرة
. This is a command from the Messenger (peace and blessings be upon him) and his approval. So how can we say that the Messenger did not do it and did not order it? The answer to this is that we say: if a woman experiences what happened to Aisha, and she insists and wishes to go out from Makkah to al-Tan'im, that is permissible. But in any other case, it is not prescribed for a person to go out to al-Tan'im to enter the state of ihram for 'Umrah. And those who do this, there is no doubt that they do not intend good, but good must be accompanied by what the Shari'ah has brought. Otherwise, it is not good to bring in a matter that the Prophet (peace and blessings be upon him) did not prescribe, nor did any of the Rightly Guided Caliphs.
