He has married another woman and has neglected her for a long time. She says: "And even now, I am fasting and praying voluntary prayers and doing charitable works. And, she says, I asked his permission to go out to my daughters and neighbors if necessary, because they are a distance of one hundred kilometers away from me, but he refused that. And even regarding fasting and voluntary prayer, I asked him for a divorce or permission, but he refused that as well. Please advise us and tell us what to do. May Allah reward you."
The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, and upon his family and his Companions, and upon those who follow them with excellence until the Day of Judgment. Our answer to this question is, first, to offer advice to this husband. If this husband has neglected his wife without a legitimate religious reason and has preferred his other wife over her, then let him be aware of what the Messenger of Allah (peace and blessings be upon him) said:Sunan Abi Dawud 2133Sahih (Al-Albani) So this husband should fear Allah and be just between his wives so as to avoid this great sin and this disgrace and shame on the Day of Resurrection. He will come on the Day of Resurrection with one side of his body tilted. And if what this woman said is true regarding his wasting of her rights and neglecting her without a legitimate religious cause, then he has no right over her. She is allowed to fast, she is allowed to pray, and she is allowed to go out for her needs, whether he gave her permission or not, because Allah the Exalted said in His Book: [Al-Baqarah 2:228].
