The questioner : I am asking about a man who got up for the Fajr prayer, then went back to sleep. He went back to sleep after he had slept. He woke up. Does he pray or not?

The Shaykh : You mean he slept after hearing the Fajr adhan, before praying Fajr?

The questioner : His brother woke him up.

The Shaykh : I do not care if his brother or his sister woke him up. What does that have to do with this? I am asking you now: does it mean he slept after waking up for the Fajr adhan and before praying the Fajr prayer?

The questioner : Yes.

The Shaykh : Okay, and when did he wake up?

The questioner : He woke up and the sun had already risen.

The Shaykh : He missed the prayer, and it is not possible to make it up as they say. It is not permissible. He must repent to Allah for what he did.

The questioner : May Allah reward you with good. So, he does not pray, meaning?

The Shaykh : He does not pray, because he is among those who neglected the prayer at its time. However, if he did not wake up for the Fajr adhan, but rather woke up for the rising of the sun, then we tell him as the Messenger (peace and blessings be upon him) said:
Whoever forgets a prayer or sleeps through it, let him pray it when he remembers it. There is no expiation for it except that. من نسي صلاة أو نام عنها فليصلها حين يذكرها لا كفارة لها إلا ذلك
As for your question, that he woke up for the Fajr adhan and then slept, in that case it is not permissible, because he caught the time and did not pray within the time, so he neglected the prayer
