The Shaykh : Scholars refer to this issue as the extra rak'ah: does the masbuq (one who joins the prayer late) count it or not?
There is scholarly disagreement on this, and the stronger position is that the masbuq counts it and it is credited to him. For example, if you join the imam in the second rak'ah of Maghrib and he forgets and adds a fourth, you should say the taslim with him because you have prayed three, and you cannot stand up to pray a fourth while believing it is the fourth, knowing it is the fourth, because that would be an intentional and deliberate addition to the prayer. The imam is excused for his fourth addition because he was forgetful, but if you add the fourth, you are not excused.
If someone were to say: "What you have mentioned contradicts the saying of the Prophet (peace and blessings be upon him):
and pray whatever you get (with the people) and complete the rest which you have missed ما أدركتم فصلوا، وما فاتكم فأتموا

" We say: There is no contradiction, because the saying of the Prophet (peace and blessings be upon him):
Complete what you missed. ما فاتكم فأتموا
indicates that this man's prayer was not completed, whereas his prayer is now completed and he has prayed three, so what is there for him to complete after he has finished the required rak'ahs?
So we say: The stronger position is that the ma'mum (one praying behind the imam) counts the extra rak'ah, and if he joins the imam in the second rak'ah and the imam adds to his prayer, he should say the taslim with the imam because his prayer has ended.
