The Wealth in Which Zakah Is Obligatory: 1 and 2 - Gold and Silver, and the Explanation of the Obligation of Zakah in Jewelry, Mentioning the Evidence and the Nisab

Machine translationRead the Arabic original
The Shaykh : Zakah is obligatory in specific types of wealth, the most common of which among people are gold, silver, paper currency, and merchandise for trade.
These are four things. Zakah is obligatory in gold and silver because the Prophet (peace and blessings be upon him) said regarding silver:
In every two hundred dirhams, a quarter of a tenth
Musannaf Ibn Abi Shaybah 4:45
And regarding gold, he said to 'Ali ibn Abi Talib (may Allah be pleased with him):
If you have twenty dinars, then in them is half a dinar
. In the Qur'an, there is a warning for those who hoard gold and silver and do not spend it in the cause of Allah. So, zakah is obligatory in gold and silver in every case, whether a person intends it for trade, for spending, or keeps it for accumulation, for wearing, or for any other purpose. This includes the jewelry that women wear, for which zakah is due, because those who say there is no zakah in it have no evidence from the Book of Allah or from the Sunnah of His Messenger. All the general texts indicate the obligation of zakah in it. We do not make obligatory what Allah has not made obligatory upon His servants; it is not our right to make obligatory what Allah has not made obligatory upon His servants, nor is it our right
to negate what Allah has made obligatory upon His servants. We have no right. The right of legislation belongs to whom? To Allah (Mighty and Majestic). And when there is disagreement among scholars regarding an issue in religion, it is obligatory to refer it to Allah, because Allah said:
And in anything over which you disagree - its ruling is [to be referred]
[Ash-Shuraa 42:10]
To whom?
to Allah إلى الله
. And He said (the Exalted):
And if you disagree over anything, refer it to Allah and the Messenger, if you should believe in Allah and the Last Day. That is the best [way] and best in result.
[An-Nisa 4:59]
. And when we refer this issue, in which scholars have disagreed in the past and present, to the Book of Allah and the Sunnah of His Messenger, we find in the Qur'an: "And those who hoard gold and silver and do not spend it in the cause of Allah, so give them tidings of a painful punishment." This is a general statement, and the hoarding of gold and silver is explained in the verse:
and spend it not in the way of Allah
[At-Tawbah 9:34]
And the greatest of what is spent in the cause of Allah is undoubtedly zakah. And we find in the Sunnah:
If any owner of gold or silver does not pay what is due on him, when the Day of Resurrection would come, plates of fire would be beaten out for him; these would then be heated in the fire of Hell and his sides, his forehead and his back would be cauterized with them. Whenever these cool down, (the process is) repeated during a day the extent of which would be fifty thousand years, until judgment is pronounced among servants, and he sees whether his path is to take him to Paradise or to Hell.
Sahih Muslim 987a
The point of indication:
If any owner of gold or silver
Sahih Muslim 987a
The scholars said that the two bracelets are the armlets. So the Prophet (peace and blessings be upon him) said to her:
Will you pay zakah? She said: No. She said: Would it please you that Allah would make them for you two bracelets of fire?
. And this is a warning. So she took them off and threw them to the Messenger of Allah (peace and blessings be upon him) and said:
They are for Allah and His Messenger
. Look at the promptness, the promptness in obedience. She did not go to argue, saying, "I prepared it for wearing, I am not trading with it." No, she threw it away and said:
They are for Allah and His Messenger
. And regarding this hadith, the Imam of the Muhaddithin in his time, al-Hafiz Ibn Hajar (may Allah have mercy on him), in his famous and well-known book Bulugh al-Maram, said: "It was narrated by the three, and its chain is strong".
As for our Shaykh 'Abd al-'Aziz ibn Baz, he said: "Its chain is authentic". And he acted upon it. That is, upon the obligation of zakah on jewelry. Please.
The student: ... .

The Shaykh : No, in wearing, rest. He said: "Its chain is authentic" and he acted upon it, and he said that zakah is obligatory on jewelry for whoever has jewelry. And this is the madhhab of Imam Abu Hanifah (may Allah have mercy on him), and it is a narration from Imam Ahmad ibn Hanbal (may Allah have mercy on him). So the statement that zakah is obligatory on jewelry is not one of the anomalous or strange opinions. It is a famous and well-known opinion supported by the Book and the Sunnah. It is what we see, and we see it as obligatory for a woman when she possesses a nisab of gold or silver, whether as jewelry or otherwise, to pay its zakah. And if her husband or one of her relatives pays it on her behalf, there is no harm. Gold and Silver
