The Shaykh : As for when a man says to his wife, "You are divorced," then this constitutes a divorce. Divorce has conditions that must be observed. One of them is that he must divorce her in a period of purity in which he did not have intercourse with her. He must not divorce her while she is menstruating, nor in a period of purity in which he had intercourse with her, unless it is established that she is pregnant, because a pregnant woman’s divorce is valid in every case. If a man divorces his wife while she is pregnant, the divorce takes effect, contrary to what some laypeople understand. They say that a pregnant woman cannot be divorced. I do not know where they got this information from. A pregnant woman can be divorced, and the divorce of a pregnant woman is the broadest of all divorces. A pregnant woman can be divorced even if he had intercourse with her, even before he performed the ritual bath from major ritual impurity; he can still divorce her. However, a woman who is not pregnant, if he has intercourse with her, cannot be divorced until she menstruates or becomes pregnant. In that case, he divorces her after her period of purity from menstruation
