Q: What is the Shari'ah method of divorce? If Zayd wants to divorce his wife, what must he do? And what is the ruling on one who divorces his wife during her days of purity after he has had intercourse with her?
A: The Shari'ah divorce is for a man to divorce his wife during a period of purity in which he did not have intercourse with her, with a single pronouncement of divorce. Then he leaves her until her waiting period ends, including in the case where she is pregnant. As for divorce during a period of purity in which he had intercourse with her, it is an irregular divorce, which is not permissible. The same applies to divorcing her during menstruation and post-natal bleeding. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
