The questioner : On the twelfth day, yes. And we performed the farewell tawaf, then we departed on the same day, and we were compelled to do so. Do we have to pay an expiation or not? And if we have to pay an expiation, can we pay it in money instead of the expiation, and where do we offer the sacrificial animal?
The Shaykh : Yes, the stronger position is that it is not permissible to stone the pillars on the eleventh day, the twelfth day, and the thirteenth day except after the sun has passed its zenith, because the Prophet (peace and blessings be upon him) did not stone except after the sun had passed its zenith on these three days, and he said: If stoning before the sun passed its zenith had been permissible in the religion of Allah, the Prophet (peace and blessings be upon him) would have stoned before the sun passed its zenith, because it would have been easier for him and easier for the Ummah. So when he turned away from that to waiting until the sun passed its zenith, this indicates that stoning before the sun passes its zenith is not permissible, and that is the case. And we say to this group: it is obligatory for you now to pay an expiation, meaning it is obligatory for each one of them to pay an expiation by slaughtering an animal in Makkah and distributing it to the poor, along with repentance to Allah the Exalted and not returning to such a thing.
