The questioner : The honorable Shaykh, a woman’s husband has passed away, and the time for the obligatory Hajj has arrived while she is in mourning. She is able and capable, and she has a mahram. Does she perform Hajj or not?

The Shaykh : She does not perform Hajj; she stays in her home. That is, if her husband dies and the time for Hajj arrives while she is in the waiting period of mourning, she remains in that state. In this case, Hajj is not obligatory upon her, due to the saying of Allah the Exalted:
And [due] to Allah from the people is a pilgrimage to the House - for whoever is able to find thereto a way ولله على الناس حج البيت من استطاع إليه سبيلا
[Ali 'Imran 3:97]

And this woman is not able, she is not able in the legal sense.

The questioner : Even if she has a mahram with her, O Shaykh?

The Shaykh : Yes, she postpones it to the second year, if Allah wills, or the third.
