Question:
From the Yemen Arab Republic, Sana'a, a message was sent by the sister Takiyyah Muhammad. In her message, she has two questions. Her first question is: I went to perform the obligatory Hajj with my husband, and a problem occurred for my husband, which led to his imprisonment and his remaining in prison. Then I obtained another passport and went to perform Hajj with my husband's sister and her husband. Is my Hajj valid despite the absence of a mahram?

Answer:
Yes, the Hajj is valid if you performed what Allah has prescribed; so the Hajj is valid. And you must repent to Allah (Glorified and Exalted is He) for traveling without a mahram; because the Prophet (peace and blessings be upon him) said:
A woman should not travel except with a mahramلا تسافر امرأة إلا مع ذي محرم
Musannaf Ibn Abi Shaybah 9:2565
Thus he (peace and blessings be upon him) said:
A woman should not travel except with a mahramلا تسافر امرأة إلا مع ذي محرم

This includes Hajj and other travel. This is the correct opinion among the scholars. However, the Hajj is valid, and you must repent to Allah for your travel without a mahram, if you performed the rituals of Hajj. We ask Allah to forgive us and you, and every Muslim.
