Explanation of the Book of Prayer and Its Times-04b

Machine translationRead the Arabic original
The reciter: Muhammad ibn al-Muthanna narrated to us, saying: Yahya narrated to us from Hisham, who said: My father informed me from Aisha, the Mother of the Believers:
that Umm Habiba and Umm Salama mentioned a church...

The Shaykh :
they saw it رأينها
.
The reciter:
they saw it رأينها
?

The Shaykh : Yes.
The reciter:
Um Habiba and Um Salama mentioned a church they had seen in Ethiopia and in the church there were pictures
Sahih al-Bukhari 3873
.

The Shaykh : In one version, it is "they saw it."
The reciter:
they had seen in Ethiopia and in the church there were pictures. When they told the Prophet (ﷺ) of this, he said, "Those people are such that if a pious man amongst them died, they build a place of worship over his grave and paint these pictures in it. Those people will be Allah's worst creatures on the Day of Resurrection . " رأينها في الحبشة فيها تصاوير فذكرتا للنبي صلى الله عليه وسلم فقال إن أولئك إذا كان فيهم الرجل الصالح فمات بنوا على قبره مسجدًا وصوروا فيه تلك الصور، فأولئك شرار الخلق عند الله يوم القيامة
Sahih al-Bukhari 3873
.

The Shaykh : Yes, he (may Allah have mercy on him) says: "Are the graves of the pre-Islamic age of ignorance to be dug up and mosques built in their place?" The answer is yes,
because the Prophet (peace and blessings be upon him) dug up the graves of the polytheists and built his mosque (peace and blessings be upon him)
as is well known, then he said "and what is disliked regarding prayer in graves". Regarding prayer in graves, it is known that a person will not pray inside a grave, and he likely meant in the cemetery, i.e., in the graveyard, because that is possible. Prayer in the cemetery is not valid; prayer in the cemetery is not valid. This is because the Prophet (peace and blessings be upon him) said:
Do not make your houses graves
Sunan Abi Dawud 2042Sahih (Al-Albani)
This is evidence that it is not possible to pray at the graves. As for praying toward a grave, there is no doubt in its invalidity, because the Prophet (peace and blessings be upon him)
forbade praying toward the graves
as in the hadith of Abu Murthad al-Ghanawi (may Allah be pleased with him). Then he mentioned the hadith of Umm Habiba and Umm Salama in which they mentioned a church
they saw it in Abyssinia, it contained images
and the Messenger (peace and blessings be upon him) clarified that these images are images of people who died, then a mosque is built over their graves—a mosque meaning the church—and images are depicted in it. These images serve as a remembrance of those who were buried in the church, or of those over whose graves the church was built. Then he (peace and blessings be upon him) clarified that these people are
the most evil of creation before Allah on the Day of Resurrection
Sunan an-Nasa'i 704Sahih (Darussalam)
.
And here we say: If a grave is built over a mosque, or if a mosque is built over a grave, it must be demolished and prayer in it is not valid. If the grave of a deceased person is in the mosque, and the mosque was established before the grave, then the grave must be dug up and the body buried in the cemetery. If that is not possible, we look to see if the grave is in the qiblah of the mosque; in that case, prayer toward it is not valid. Or if it is to the right of the one praying, or to his left, or behind him, then prayer in the mosque is valid.
Some people have found it difficult to reconcile the grave of the Prophet (peace and blessings be upon him and his family) being in the mosque, but there is no difficulty except for a stubborn man who wants to compel people to the permissibility of burial in mosques, or to tell people, "Leave us alone and we will leave you alone." This is because the grave of the Prophet (peace and blessings be upon him and his family) was not buried in the mosque, nor was a mosque built over it. When the people increased in the era of al-Walid ibn 'Abd al-Malik, he wrote to 'Umar ibn 'Abd al-'Aziz (may Allah have mercy on him) to expand the mosque. They saw that the closest direction for expansion was the eastern side, so they expanded it from the eastern side. At that time, the houses of the Mothers of the Believers would be included, so the houses were demolished and the mosque remained in the room of Aisha. Thus, the mosque was not built over the grave, and the grave was not buried in the mosque. How is this like the action of the polytheists, or the action of those who build over graves, who bury the dead and then bring a dome or the like and place it over them?
