The Prohibition of Prayer in a Mosque Containing a Grave

Machine translationRead the Arabic original
Question:
He says in his third question: A mosque contains the grave of its owner, and it is surrounded by a wire fence. Is it permissible to pray in it? What is the ruling on one who intentionally does so? May Allah reward you with good.
AAnswer:
In all mosques that contain graves, prayer is not performed, and prayer in them is invalid. If the mosque is the older structure and the person was buried in it, the buried person must be exhumed, exhumed, and his remains transferred to the public cemetery, and prayer is performed in the mosque. However, if the grave is the older structure and the mosque was built over it, the mosque must be demolished, demolished and removed; because it was founded on misguidance. The Prophet (peace and blessings be upon him) said in the authentic hadith, he (peace and blessings be upon him) said:
May Allah fight the jews and the christians. They took the graves of their Prophets as places of prostrationقاتل الله اليهود والنصارى؛ اتخذوا قبور أنبيائهم مساجد
Muwatta Malik 45:17
And in the other wording:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى؛ اتخذوا قبور أنبيائهم مساجد
Sahih Muslim 529
And he (peace and blessings be upon him) said:
Beware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.ألا وإن من كان قبلكم كانوا يتخذون قبور أنبيائهم، وصالحيهم مساجد، ألا فلا تتخذوا القبور مساجد؛ فإني أنهاكم عن ذلك
Sahih Muslim 532
.
And Umm Salama and Umm Habiba said to him when they emigrated to Abyssinia: "They saw a church in Abyssinia containing images." The Prophet (peace and blessings be upon him) said:
If any righteous pious man dies amongst them, they would build a place of worship at his grave and make these pictures in itأولئك إذا مات فيهم الرجل الصالح؛ بنوا على قبره مسجدًا، وصوروا فيه تلك الصور
Sahih al-Bukhari 434
Then he said:
Those are the worst creatures in the Sight of Allah.أولئك شرار الخلق عند الله
Sahih al-Bukhari 1341
So he informed them that they are the worst of creation; because of their building over graves and making images on them. We ask Allah for safety.
The point is: It is obligatory not to build over graves, no domes, no mosques .. or anything else. They must be left exposed, with no building over them, as they were in the time of the Prophet (peace and blessings be upon him) in al-Baqi', left exposed, and nothing added to them except their earth. They are raised approximately a hand's breadth; so that it is known that they are graves. No prayer is performed between them, or toward them, and no domes, stones, or mosques are built over them, and they are not covered. All of this is reprehensible, and all of it is among the means of shirk (associating partners with Allah), all of this is among the means of shirk.
So it is obligatory to be cautious of that, and in any mosque that contains a grave, no prayer is performed in it. But if the grave is the newer one, it is exhumed, placed in the cemeteries, and prayer is performed in the mosque. If the graves are the older ones, and then the mosque was built over them, the mosque is demolished, and no prayer is performed in it. Yes.

The presenter: May Allah reward you with good, and may He reward you. This wire fence that he mentions, and he says: The mosque is surrounded by a wire fence. Does it benefit, and have an effect, or does it have no effect?

The Shaykh: This wire fence is removed, cut, removed if it is intended to honor the dead, or to indicate his grave.. or something similar; it is removed. The point is that it has no need, and no reason that obligates the wire fence, so the wire fence that they believe in must be removed.
The presenter: May Allah reward you with good.
