The reciter: Ali ibn Abdullah narrated to us, saying: Sufyan narrated to us from Yahya from Ummara from Aisha, who said:
Barira came to her asking about her contract of manumission. She said, "If you wish, I will give your people the remaining amount, and the patronage will be mine." Her people said, "If you wish, give her what remains, and the patronage will be ours." Sufyan said once, "If you wish, manumit her, and the patronage will be ours." When the Messenger of Allah (peace and blessings be upon him) came, she mentioned this to him. The Prophet (peace and blessings be upon him) said, "Buy her and manumit her, for the patronage belongs to the one who manumits." Then the Messenger of Allah (peace and blessings be upon him) stood on the pulpit. Sufyan said once, "The Messenger of Allah (peace and blessings be upon him) ascended the pulpit and said, 'What is the matter with people who stipulate conditions that are not in the Book of Allah? Whoever stipulates a condition that is not in the Book of Allah, it is not valid for him, even if he stipulates it a hundred times.'" أتتها بريرة تسألها في كتابتها فقالت إن شئت أعطيت أهلك ويكون الولاء لي وقال أهلها إن شئت أعطيتها ما بقي وقال سفيان مرة إن شئت أعتقتها ويكون الولاء لنا فلما جاء رسول الله صلى الله عليه وسلم ذكرته ذلك فقال النبي صلى الله عليه وسلم ابتاعيها فأعتقيها فإن الولاء لمن أعتق، ثم قام رسول الله صلى الله عليه وسلم على المنبر وقال سفيان مرة فصعد رسول الله صلى الله عليه وسلم على المنبر فقال ما بال أقوام يشترطون شروطا ليس في كتاب الله من اشترط شرطا ليس في كتاب الله فليس له وإن اشترط مائة مرة

The Shaykh : His statement (may Allah have mercy on him), "The chapter on mentioning buying and selling on the pulpit in the mosque," means discussing buying and selling, not the actual act of buying or selling, because buying and selling in the mosque is forbidden, as the Prophet (peace and blessings be upon him and his family) said:
When you see someone selling or buying in the Masjid then say: 'May Allah not profit your business.' إذا رأيتم من يبيع أو يبتاع في المسجد فقولوا لا أربح الله تجارتك، فإن المساجد لم تبن لهذا

However, discussing buying and selling regarding their rulings, conditions, and the like is permissible. Then he mentioned the hadith of Barira with Aisha (may Allah be pleased with her). Barira was a mukataba (a slave under a contract of manumission), and her people had contracted her for nine ounces of silver. She came to seek Aisha's (may Allah be pleased with her) help. Aisha offered to pay them the ounces and manumit her, so that the patronage of this slave, Barira, would belong to Aisha. Barira went to her people and told them this, but they refused, saying, "The patronage must be ours." Barira came to Aisha and informed her, and Aisha mentioned this to the Messenger of Allah (peace and blessings be upon him and his family). He said:
Take her and stipulate that the wala' is yours, for the wala' is for the one who sets free خذيها واشترطي لهم الولاء فإنما الولاء لمن أعتق
Muwatta Malik 38:18
Then he stood and addressed the people, establishing this legal ruling, and he (peace and blessings be upon him) said:
Whoever imposes conditions which are not in Allah's Book (Laws), his conditions will be invalid even if he imposed them a hundred times. من اشترط شرطا ليس في كتاب الله فليس له وان اشترط مائة مرة
