The questioner : A man who does not pray Fajr until after the sun has risen, and this is his constant practice, while he prays the other prayers in the mosque; what is the ruling on that, may you be rewarded?

The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, the Seal of the Prophets, and upon his family and his Companions, and those who follow them in excellence until the Day of Judgment. The prayer is of great importance and its status is high; it is the pillar of Islam, and there is no Islam for one who has no prayer. This man about whom the question was asked did not pray Fajr until after the sun had risen on a continuous basis, but he prays the remaining times with the congregation.

The questioner : Yes.

The Shaykh : We ask Allah the Exalted to guide him and to complete His blessing upon him.

The questioner : O Allah, amen.

The Shaykh : Until he prays Fajr with the congregation so that his prayer is completed in the required manner. The fact that he does not pray Fajr until after the sun has risen on a continuous basis indicates his negligence regarding it and his lack of concern for it. So we say to him: If this is your prayer on a continuous basis, then you have no prayer, meaning the Fajr prayer is not accepted because it is performed outside its time without an excuse. It is established from the Prophet (peace and blessings be upon him) that he said:
He who did any act for which there is no sanction from our behalf, that is to be rejected. من عمل عملاً ليس عليه أمرنا فهو رد

That is, it is rejected. So there is no doubt that prayer after its time without a Sharia excuse is an act that is not in accordance with the command of Allah and His Messenger, and thus it is rejected. This man might say: I am sleeping, and the pen is lifted from the sleeper. It is established from the Prophet (peace and blessings be upon him) that he said:
Whoever sleeps through a prayer or forgets it, let him pray it when he remembers it. من نام عن صلاة أو نسيها فليصلها إذا ذكرها
So we say to him: The sleep for which a person is excused is sleep that is occasional, not constant. As for sleep that a person persists in every day and does not pray Fajr until its time has passed, this is not an excuse. So our brother should fear Allah Mighty and Majestic and complete what Allah has blessed him with of Islam by performing the Fajr prayer with the congregation. We ask Allah for assistance for us and for him.
