Ruling on delaying the Fajr prayer until after the sun rises
Machine translationRead the Arabic original
Question:
This questioner says: I am an Egyptian woman, and my husband works in the Kingdom, and I reside with him. He does not wake up for the Fajr prayer while it is still in its time; rather, he prays it late, after the sun has risen, around nine in the morning. He says that he is unable to get up for the prayer because he is tired. As for the other obligatory prayers, he prays them in their times. What is the ruling on this man’s action, O Shaykh?
Answer:
This action is reprehensible and not permissible. He must pray Fajr in its time, like the other prayers, and he must sleep early so that he can get up for it in its time. Deliberately delaying it is disbelief according to a group of scholars, because it is deliberately leaving it in its time. The Prophet (peace and blessings be upon him) said in the authentic hadith:Sunan Ibn Majah 1079Sahih (Darussalam) And he (peace and blessings be upon him) said: It is obligatory for him to do the things that help him get up so that he prays it in its time. He must pray it in congregation in the mosques, not in his house. He should pray it with his Muslim brothers in the mosques. This is obligatory upon him, and he must not be lax in this matter. We ask Allah for well-being and safety.

The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.
