A5: If a person sleeps through the Fajr prayer or forgets it until the sun has risen, it is prescribed that he begins with the Sunnah of Fajr before it. If he is unable to perform it before the prayer, such as if he joins the congregation, he prays it after the obligatory Fajr prayer. This is based on what Abu Dawud narrated in his Sunan from Qays ibn 'Amr who said:Mishkat al-Masabih 1044 . This indicates that if one is unable to perform the Sunnah of Fajr before the obligatory prayer, he prays both after it or
