The questioner : May Allah reward you. He says: I borrowed a sum of money from the real estate bank, and repayment, as is known, is over a long period. The question is: if the man dies and wills to his heirs to pay off the debt on his behalf, is his conscience cleared of this debt?

The Shaykh : This is a matter people ask about often. The one who borrowed from the real estate bank, it is known that the building he constructed with this loan is mortgaged. Mortgaged to whom? To the bank. So if the person dies and has paid all the installments that came due during his life, he is cleared, and the right to this property transfers to the liabilities of the heirs. Pay attention to this.
As for if there were installments that came due before he died and he did not pay them, it is obligatory for the heirs to hasten to pay them, even if it requires selling the property, and it is not permissible for them to delay them. Yes.
