Q1: I am an elderly woman, and there is a matter that distresses me greatly, and I fear that my time will come and I will be held accountable for a sin because of this problem. It is summarized as follows: I bought two plots of land several years ago for 59,000 riyals, and I took a loan from the Real Estate Development Fund, and I built a house and an annex on
the two plots
, and praise be to Allah. I and my three sons, 'Ali, 'Abd al-Rahman, and Muhammad, lived in the house, and the two of them, 'Abd al-Rahman and Muhammad, paid some of the installments, then they stopped paying. After a while, my middle son, 'Abd al-Rahman, moved out to a separate house, and I remained with Muhammad and 'Ali, who does not work, in this house. My questions are: If my youngest son, Muhammad, agrees to pay the installments due to the real estate bank and writes that at the bank, and his brothers permit it, will the house become his property and will I be absolved of the bank's right?

A1: The bank's debt remains in your liability until you pay it off, and it is not absolved from you by some of your children or others taking it on. Selling the house to your son is permissible if the bank permits it or if it is for the amount of its remaining price without injustice to him, but the debt remains in your liability until you pay it off. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
