What is the ruling on swearing by the Prophet or by trust?

Machine translationRead the Arabic original
The questioner : What is the ruling on swearing by the Prophet or by trust?

The Shaykh : Swearing by the Prophet (peace and blessings be upon him and his family) is a type of shirk (associating partners with Allah), because swearing is a way of affirming something by mentioning something revered. So it is as if the one swearing is saying, "I affirm this matter just as I revere this thing by which I am swearing." Therefore, swearing is specific to Allah (Mighty and Majestic), and it is not permissible to swear by the Prophet, nor by Jibril, nor by children, nor by any other of Allah’s (Blessed and Exalted is He) creation. The Prophet (peace and blessings be upon him and his family) said:
Whoever has to take an oath should swear by Allah or remain silent. من كان حالفاً فليحلف بالله أو يصمت
Sahih al-Bukhari 2679
.
Swearing by trust is likewise not permissible, because it is swearing by other than Allah. It was narrated from the Prophet (peace and blessings be upon him) that he said:
He who swears by Amanah (faithfulness) is not one of us. من حلف بالأمانة فليس منا
Sunan Abi Dawud 3253Sahih (Al-Albani)
However, sometimes a person says, "By my trust," meaning by the covenant and the pledge, and does not mean the oath. He says, "By my trust, I will fulfill it for you," or "By my pledge, I will fulfill it for you." The intention is commitment, not revering the trust or revering the pledge. This is not prohibited, except as a precaution, out of fear that someone who swears by trust or pledge might follow his example.

The questioner : May Allah reward you.

The Shaykh : What I know from the original intent of the common people when they say, "By my pledge, I will do such and such," is that they mean the covenant, not swearing by the pledge. Yes.

The questioner : The questioner says.
