The Shaykh : By Allah, it is worthy of care and attention because it is the greatest pillar of Islam after the two testimonies. The stronger and required position with us is that the one who abandons it out of laziness and negligence is a disbeliever who has exited Islam. Listen, my brother, a disbeliever who has exited Islam. If he dies, he is not washed, not shrouded, no prayer is performed over him, and he is not buried with the Muslims, nor is he supplicated for with mercy or forgiveness. Why? Because he is a disbeliever, and it is not permissible to supplicate for a disbeliever with mercy. So what do we do with this man who died while not praying, and we know that he did not pray? What do we do? We load him onto a regular truck, a basin, yes. And we take him out to the open land, far from buildings, and we dig a hole for him or make a grave for him? Yes? A hole, and we throw him in it, throwing him like a carcass. In fact, he is more vile than a carcass because he is a disbeliever. And a disbeliever is more vile than animals.
They are not except like livestock. Rather, they are [even] more astray in [their] way. إن هم إلا كالأنعام بل هم أضل سبيلا
[Al-Furqan 25:44]
. Now, if a person says, "What about my father? Do I do this to him? How do I do this to him?" We say: Fine, your father is now an enemy to you, because every disbeliever is an enemy to the believer. Your father is an enemy to Allah. And every enemy to Allah is an enemy to the awliya (close friends of Allah). Have you not seen Noah (peace be upon him), who was one of the resolute messengers and the first messenger Allah sent to the people of the earth, when one of his sons was a disbeliever? When Allah the Exalted intended to destroy his people by drowning, He said:
My Lord, indeed my son is of my family; and indeed, Your promise is true; and You are the most just of judges!" رب إن ابني من أهلي وإن وعدك الحق وأنت أحكم الحاكمين
[Hud 11:45]
meaning what? He said this to Allah. What does he want? What does he want, people? He wants to save the son because his father said to him:
(42) And it sailed with them through waves like mountains, and Noah called to his son who was apart [from them], "O my son, come aboard with us and be not with the disbelievers." (43) [But] he said, "I will take refuge on a mountain to protect me from the water." [Noah] said, "There is no protector today from the decree of Allah, except for whom He gives mercy." And the waves came between them, and he was among the drowned. اركب معنا ولا تكن من الكافرين قال سآوي إلى جبل يعصمني من الماء
[Hud 11:42-43]
. He took refuge in the mountain, but it did not protect him, so he said:
My Lord, indeed my son is of my family; and indeed, Your promise is true; and You are the most just of judges!" رب إن ابني من أهلي وإن وعدك الحق وأنت أحكم الحاكمين
[Hud 11:45]
. What did Allah say to him?
He said, "O Noah, indeed he is not of your family; indeed, he is [one whose] work was other than righteous قَالَ يا نوح إِنَّهُ لَيْسَ مِنْ أَهْلِكَ إِنَّهُ عَمَلٌ غَيْرُ صَالِحٍ
[Hud 11:46]
meaning your question is an unsound deed.
Indeed, I advise you, lest you be among the ignorant." إِنِّي أَعِظُكَ أَنْ تَكُونَ مِنَ الْجَاهِلِينَ

. This is severe, great speech with which Allah addresses whom? A messenger from the messengers, from the resolute ones. He says:
He said, "O Noah, indeed he is not of your family; indeed, he is [one whose] work was other than righteous, so ask Me not for that about which you have no knowledge. Indeed, I advise you, lest you be among the ignorant." إِنَّهُ لَيْسَ مِنْ أَهْلِكَ إِنَّهُ عَمَلٌ غَيْرُ صَالِحٍ فَلَا تَسْأَلْنِ مَا لَيْسَ لَكَ بِهِ عِلْمٌ إِنِّي أَعِظُكَ أَنْ تَكُونَ مِنَ الْجَاهِلِينَ
[Hud 11:46]
. So, even if the one who does not pray is my father, I do not care at all to implement what the Shari'ah requires, and to take him out in his clothes and throw him into any hole. Even if he were my son, because he has no honor or respect. This is the one who abandons prayer. As for the rulings of this world, he is never married to a Muslim woman, and if he is married, what? The marriage is invalid due to the saying of Allah the Exalted:
And if you know them to be believers, then do not return them to the disbelievers; they are not lawful [wives] for them, nor are they lawful فَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلَا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ لَا هُنَّ حِلٌّ لَهُمْ وَلَا هُمْ يَحِلُّونَ
[Al-Mumtahanah 60:10]
The marriage is invalid. And if it happened inadvertently while he was not praying, it is obligatory to renew the contract. They are separated and the contract is renewed, because the first contract was invalid. Now, if he has a wife, he married a woman while he was praying, then Satan took hold of him and he stopped praying. What do we do? It is obligatory to separate him from his wife, because she is not lawful for him now until he returns and prays, and then we return his wife to him.
The matter of prayer is not a trivial one. And Abdullah ibn Shaqiq, one of the famous Tabi'un (the generation after the Companions), said: "The Companions of the Messenger of Allah (peace and blessings be upon him) did not consider any act of worship whose abandonment is disbelief except prayer". And this is a transmitted consensus. And the transmission of the consensus is by Ishaq ibn Rahawayh (may Allah have mercy on him), one of the famous imams: "That the Companions agreed upon the disbelief of the one who abandons prayer". And the evidence from the Qur'an and the Sunnah is known to those who reflect upon it. So the Book, the Sunnah, and the consensus of the Companions indicate the disbelief of the one who abandons prayer. And so does correct reasoning, people. Is it possible for a person to persist in abandoning the prayer, whose importance is known by necessity from the religion, which Allah obligated upon His Messenger without intermediary, which Allah obligated upon His Messenger in the highest place humans have reached, as we know, which Allah obligated upon His Messenger as fifty prayers in the day and night, and then He lightened it? Is it possible for any believing person to persist in abandoning this prayer? By Allah, if he had faith in his heart, he would have prayed. As for merely acknowledging that Allah alone has no partner and that Muhammad is His servant and Messenger, this does not benefit him. Not everyone who says "There is no god but Allah, Muhammad is the Messenger of Allah" is a Muslim. The hypocrites say yes, the hypocrites mention Allah, as He the Mighty and Majestic said:
And when they stand for prayer, they stand lazily, showing [themselves to] the people and not remembering Allah except a little, وَإِذَا قَامُوا إِلَى الصَّلَاةِ قَامُوا كُسَالَى يُرَاءُونَ النَّاسَ وَلَا يَذْكُرُونَ اللَّهَ إِلَّا قَلِيلًا
[An-Nisa 4:142]
. And they say, "We testify that Muhammad is the Messenger of Allah"
When the hypocrites come to you, [O Muhammad], they say, "We testify that you are the Messenger of Allah." إِذَا جَاءَكَ الْمُنَافِقُونَ قَالُوا نَشْهَدُ إِنَّكَ لَرَسُولُ اللَّهِ
[Al-Munafiqun 63:1]
and yet they are in the lowest depth of the Fire. We have a small treatise, small in size but great in benefit, explaining the disbelief of the one who abandons prayer. We mentioned in it the evidence of those who declare the one who abandons prayer a disbeliever, and we answered the evidence of those who do not declare him a disbeliever. And that their evidence does not hold up for what they used it as evidence for.
I ask Allah to make me and you among those who establish prayer, enjoin what is right, and forbid what is wrong.
So it is confirmed for us, if we want to stand for prayer, what? What? That we use the miswak. Is this at all times, day and night? Yes. The answer is likewise. Now, if a person is fasting, does he use the miswak? A fasting person uses the miswak. At the beginning of the day, he uses the miswak. At the end of the day, he uses the miswak. At all times. Amir ibn Rabi'ah said:
he had seen the Prophet more often than he could count using a toothstick while he was fasting رأيت النبي صلى الله عليه وعلى آله وسلم ما لا أحصي يتسوك وهو صائم

And the Prophet (peace and blessings be upon him) said:
Siwak is a means of purification for the mouth and is pleasing to the Lord. السواك مطهرة للفم مرضاة للرب
Sunan an-Nasa'i 5Sahih (Darussalam)
. And he did not exclude anything. As for the dislike by some scholars of a person using the miswak after the sun passes its zenith if he is fasting, that is a weaker position.
