What is the ruling on one who swears by [by your life]? And what is the evidence?

The questioner : In the name of Allah, the Most Gracious, the Most Merciful.
O Shaykh, may Allah preserve you, what is the ruling on swearing by this word "by your life" which we hear often in verses of poetry, with an explanation of the evidence? And some of them said it is permissible on the grounds that it was said among the Salaf and they did not disapprove of it?

The Shaykh : As for if it is from Allah, then this is permissible, and in the Qur'an:
By your life, [O Muhammad], indeed they were, in their intoxication, wandering blindly. لَعَمْرُكَ إِنَّهُمْ لَفِي سَكْرَتِهِمْ يَعْمَهُونَ
[Al-Hijr 15:72]
As for if it is from a created being to a created being, then it is not the oath about which the Messenger (peace and blessings be upon him) said:
He who swears by anyone or anything other than Allah, has indeed committed an act of Kufr or Shirk من حلف بغير الله فقد كفر أو أشرك

Because the oath has a specific form that begins with the waw, or the ba, or the ta.
As for "by your life," it is not an explicit oath, and for this reason it came in the hadith:
By my life لعمري
And it also came in the athar from the Companions that they used to say:
By my life لعمري
.
As for "by your life," I do not recall now that it was transmitted from the Salaf, neither as a statement nor as an approval. But "by my life" was transmitted, and I think there is no difference between "by my life" and "by your life," because they are all the life of a person, which is a created thing. Yes, that is right.
