The questioner : In the name of Allah, the Most Gracious, the Most Merciful.
His EminenceThe Shaykh : A man from the residents of Makkah was able to perform Hajj, but he did not; he kept postponing it, saying every year, "Next year," until he died. Does he have to make up the Hajj?

The Shaykh : The correct view is that it is performed on his behalf if he was intending to perform Hajj but was lazy. However, if he was intending to leave it off, it is not performed on his behalf; rather, it remains a debt in his record, and he will be punished for it on the Day of Resurrection, if Allah wills. This is the detail that brings peace to the soul. But let it be known that Hajj is an immediate obligation, and it is not permissible for one who is able to perform it to postpone it, due to the saying of Allah the Exalted:
And [due] to Allah from the people is a pilgrimage to the House - for whoever is able to find thereto a way ولله على الناس حج البيت من استطاع إليه سبيلًا
[Ali 'Imran 3:97]
He conditioned it with the ability; whenever the ability is present, Hajj becomes obligatory. Yes.
