External Fatwas Concerning the Rites of Pilgrimage?

Machine translationRead the Arabic original
The Shaykh : All right, please proceed with your questions.

The questioner : Does the pilgrim have to offer a sacrifice, O Shaykh?

The Shaykh : This question was asked just a moment ago, and we said that Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) says: “There is no sacrifice required of the pilgrim, nor is it prescribed for him to offer a sacrifice, because the hady is a substitute for it.”

The questioner : May Allah reward you, O Shaykh. Is it valid to offer a sacrifice with a sheep whose rump is cut off and whose ear is pierced?

The Shaykh : What do you mean by “cut off”? What? Repeat the question, my brother.

The questioner : If Allah wills, is it valid to offer a sacrifice with a sheep whose rump is cut off and whose ear is pierced?

The Shaykh : The rump?

The questioner : The ear, yes.

The Shaykh : But the rump, what is the rump?

The questioner : O Shaykh, to offer a sacrifice with a sheep whose rump is cut off.
The student: Perhaps the rump.

The Shaykh : No, the rump. What is it? I didn’t understand. What is cut off?

The questioner : The rump.

The Shaykh : What is the rump?

The questioner : The fat is cut off.

The Shaykh : Ah, the rump.

The questioner : Yes.

The Shaykh : All right, or what?

The questioner : Or the ear is pierced.

The Shaykh : May Allah bless you. If the ear is pierced, the sacrifice is sufficient, meaning if he offers it as a sacrifice, his sacrifice is valid. In fact, even if the ear is completely cut off, it is still valid, though it is disliked. As for the rump being cut off, the scholars said that it is not valid to offer a sacrifice with it. As for the tail being cut off, it is valid to offer a sacrifice with it. Accordingly, if the tail is cut from a cow, a camel, or a goat, the sacrifice is sufficient. But if it is cut from a sheep, the jurists said: it is not sufficient. This is because the fat of the sacrifice is intended, so it is like cutting off a hand or a leg. Yes.

The questioner : May Allah reward you, O our Shaykh. What are the time-bound acts of worship whose time extends to the night following travel?

The Shaykh : In the rites of pilgrimage, you mean?

The questioner : Yes.

The Shaykh : Yes.

The questioner : Or others, O Shaykh?

The Shaykh : No, there is nothing else. Night acts of worship are in the night, and day acts of worship are in the day. But in the rites of pilgrimage, may Allah protect you, standing at 'Arafah extends until the dawn of the day of 'Id. And there is stoning the pillars on the days of Tashriq. Likewise, on the day of 'Id, it extends after the setting of the sun until the dawn.

The questioner : O our Shaykh, is it permissible to stone the pillars on the thirteenth day before noon, due to the departure of the ... travel?

The Shaykh : The correct view is that it is not permissible, and staying until the thirteenth is not necessary, because a person can hasten and leave Mina on the twelfth day. But ... the one who can, if his travel is on the twelfth day and he needs to stone before noon, that is the one in which there is ... As for the thirteenth, there is no hardship in it because he is hastening, and there is no issue.

The questioner : May Allah reward you.
Another questioner: ... the one performing sa'y, the saying of Allah the Exalted:
Indeed, as-Safa and al-Marwah are among the symbols of Allah إن الصفا والمروة من شعائر الله
[Al-Baqarah 2:158]
when he ascends the Marwah and is unable, the verse ...

The Shaykh : This verse, may Allah bless you,
Indeed, as-Safa and al-Marwah are among the symbols of Allah إن الصفا والمروة من شعائر الله
[Al-Baqarah 2:158]
is not recited on al-Safa or on al-Marwah, but rather it is recited when a person approaches al-Safa after exiting the tawaf, only once. He does not repeat it, and he does not recite it when he approaches al-Marwah, because the purpose of it is to remind the person to be aware that he is performing sa'y in obedience to the command of Allah. Yes, is that clear?

The questioner : O our Shaykh: What is the difference between inabah (returning) and tawbah (repentance)?

The Shaykh : Tawbah is turning away from sins, and inabah is moving toward the Lord, Mighty and Majestic, involving some acts of obedience after the tawbah.

The questioner : May Allah reward you.
Another questioner: O our Shaykh, is it permissible ... for the one performing ifrad to offer the hady of Hajj?

The Shaykh : Yes, indeed. Sending the hady is a recommended practice for the one performing qiran and the one performing ifrad. But he should, if he sends the hady, enter the state of ihram with qiran, following the Messenger of Allah (peace and blessings be upon him and his family).

The questioner : Is it prescribed for one who is not a pilgrim, O our Shaykh?

The Shaykh : Huh?

The questioner : Is it prescribed for one who is not a pilgrim?

The Shaykh : You mean offering it as a gift?

The questioner : Yes.

The Shaykh : Offering it as a gift?

The questioner : Yes, O Shaykh, yes.

The Shaykh : Yes, it is prescribed. For the Prophet (peace and blessings be upon him and his family) used to send the hady from Madinah to Makkah while he remained in Madinah.

The questioner : May Allah reward you...

The Shaykh : No, there is an addition, and you are, praise be to Allah, always in demand.

The questioner : May Allah reward you with good.

The Shaykh : May Allah bless you.

The questioner : May Allah reward you, O our Shaykh: The government gives every employee a Hajj ... every ten years ... Many people say that this is ... and they want to perform Hajj from their own money. Is there any harm in this?

The Shaykh : I do not see any harm in this, because the Messenger of Allah (peace and blessings be upon him and his family) said to 'Umar ibn al-Khattab:
out of this wealth which comes to you without your being avaricious and without begging ما جاءك من هذا المال وأنت غير مشرف وسائل فخذه
Sahih Muslim 1045a
.

The questioner : May Allah reward you, O Shaykh: We ask a question that was raised ... regarding the right of a test-tube baby, if ... the doctor ... is this permissible?

The Shaykh : I do not issue a fatwa on that, yes.

The questioner : Peace be upon you ...

The Shaykh : No, I do not issue a fatwa on its permissibility or its impermissibility, because issuing a fatwa on its permissibility is feared to lead to a danger. Otherwise, the scholars have stated that it is permissible for a woman to be impregnated with her husband's sperm to become pregnant with it. But we do not like for a fatwa to be issued on this so that the great danger does not occur. Yes, indeed.

The questioner : May Allah reward you, O Shaykh: Is a wife’s obedience to her husband in terms of cooking, sweeping, and washing clothes an obligatory obedience?

The Shaykh : The measure in this is the saying of Allah the Exalted:
and live with them in kindness وعاشروهن بالمعروف
And if the custom among people is that she does not perform these things, or performs some of them and not others, then it is according to what has become customary. People in the past were in a state of poverty and need, so the woman, I mean the wife, would take care of all the needs of the house, cleaning it and sweeping it, and she would also cook, wash clothes, and wash dishes, and everything. And although things have changed in reality now, people in the past used to eat lunch and dinner in one vessel. Now, if lunch is served, how many vessels are there? Yes, it can be five or six, at least.

The questioner : Yes.

The Shaykh : Yes, indeed. The important thing is that this returns to custom, because Allah made that to be considered by custom.

The questioner : May Allah reward you, Shaykh.

The Shaykh : Give it to me.

The questioner : ...

The Shaykh : Please, the question.

The questioner : My wife suffered a miscarriage in her third month.

The Shaykh : Yes.

The questioner : Does she pray, or does she wait until she is purified?

The Shaykh : Yes, indeed. The jurists say, may Allah bless you, that if the miscarriage occurs when the creation of a human being has become apparent in the pregnancy, meaning his hands are distinguished from his legs, for example, then this is post-natal bleeding. The general rule is that if it is three full months, the general rule is that the creation of a human being has become apparent in it. But if it is eighty days or less, then it is not possible for the creation of a human being to become apparent in it, so the blood here is corrupt blood. She does not leave off prayer for it; she prays and fasts, and it is lawful for her husband. So the criterion is what? That the creation of a human being becomes apparent, and it is not possible for it to become apparent before eighty days. Yes.

The questioner : May Allah reward you, O Shaykh, and increase you in faith and certainty.

The Shaykh : Amen, and for you and the listeners. May Allah reward you with good. Peace be upon you and Allah’s mercy.

The questioner : And upon you be peace and the mercy of Allah.
