It is not permissible for a person, when he passes the miqat intending Hajj or 'Umrah, to pass it without entering the state of ihram, because the Prophet (peace and blessings be upon him) prescribed these miqats and said:Sunan al-Bayhaqi 4:296.
If one passes the miqat without entering the state of ihram and then enters it from a place beyond it, the scholars say that he owes a fidyah, which he must slaughter in Makkah and distribute to the poor, and he must not eat any of it.
