Question: The brother / S. W. from Najran says: I intended to visit my sister in Jeddah and also to perform 'Umrah. I traveled by plane from Najran to Jeddah and stayed in Jeddah that day. On the second day, I went to Makkah for 'Umrah. Is my 'Umrah valid or not?

Answer: If you entered the state of ihram from the miqat, which is Yalamlam—the miqat of the people of Yemen—then you owe nothing. But if you entered the state of ihram from Jeddah, then you must sacrifice a sacrificial animal in Makkah for the poor; because you passed the miqat without entering the state of ihram, and you had intended to perform 'Umrah. This is based on the saying of the Prophet (peace and blessings be upon him) when he designated the miqats:
and those (Mawaqit) are also meant for those who live at these (places) and for those too who come from without towards them for the sake of Hajj or 'Umraهن لهن ولمن أتى عليهن من غير أهلهن ممن أراد الحج والعمرة

This hadith is agreed upon by al-Bukhari and Muslim. And based on the saying of Ibn 'Abbas (may Allah be pleased with him and his father):
Whoever leaves a ritual act or forgets it, let him shed blood.من ترك نسكًا أو نسيه فليهرق دمًا
Failing to enter the state of ihram from the miqat that you passed is considered leaving off a ritual act. May Allah guide them all.
