The questioner : His EminenceThe Shaykh : Regarding the hadith of Ibn 'Umar (may Allah be pleased with him) when he divorced his wife, and the Messenger of Allah (peace and blessings be upon him) said to 'Umar's father, "Take her back," when he divorced her while she was menstruating:
take her back until she becomes pure (i.e., her period ends), then she has her period (again), then she becomes pure (again), then if he wishes he may divorce her راجعها حتى تطهر ثم تحيض ثم تطهر ثم طلقها

How is the Sunnah divorce performed?

The questioner : Based on this hadith, does the Sunnah divorce occur after one menstruation or two?

The Shaykh : This hadith indicates that if he divorces her during menstruation, he is to be dealt with strictly, and it is said: Do not divorce her during the period of purity following the menstruation in which the divorce took place until she menstruates a second time and then becomes pure. However, this is not on the basis of obligation, because in some wordings of the hadith
Tell him to take her back, then let him divorce her while she is pure or pregnant. مره فليراجعها ثم ليطلقها طاهرًا أو حاملًا

and there is no repetition in it. But if the mufti or judge sees fit to be strict with this divorcer, preventing him and detaining him until she becomes pure from the second menstruation, that is better. Otherwise, if he divorces her after the purity following the menstruation in which the divorce took place, the divorce is valid.
