The questioner : Is it permissible for a man to perform Hajj or 'Umrah on behalf of his brother after his death, if he did not bequeath it to him?

The Shaykh : There is no blame on a person for performing Hajj and 'Umrah on behalf of his brother after his death, even if he did not bequeath it to him. This is because Ibn 'Abbas (may Allah be pleased with him and his father) mentioned that the Prophet (peace and blessings be upon him) heard a man saying: "Labbaik on behalf of Shubrumah." The Prophet (peace and blessings be upon him) said:
Who is Shubrumah? من شبرمة ؟
The man said: "He is my brother or a relative of mine." The Prophet (peace and blessings be upon him) said:
Have you performed Hajj for yourself? أحججت عن نفسك؟
The man said: "No." The Prophet (peace and blessings be upon him) said:
perform hajj on your own behalf, then perform it on behalf of Shubrumah. حج عن نفسك ثم حج عن شبرمة

He did not say to him: "Did he bequeath it to you or give you permission for this?"
If this had been a condition, the Prophet (peace and blessings be upon him) would have made it clear.
