The questioner : I have a brother who supports about three children in various stages of their education. His monthly income does not cover the cost of living, and he is suffering from an illness that requires long-term treatment. However, he smokes cigarettes, sometimes prays, and is not regular in his prayer. Does he deserve my zakah or not? May you be rewarded.

The Shaykh : If your brother’s situation is as you described, then he deserves zakah. However, you should say to him: “I have zakah money; what would you like me to buy for you from the household necessities?” Then you buy for him with that money what he needs for his home, such as expenses or appliances like a washing machine, a water cooler, a refrigerator, and the like. This is because one afflicted with smoking, if he has money, will first use it to buy cigarettes.
It is well known that smoking is forbidden because it involves wasting money and weakening the body, and it is disliked in some cases. Therefore, we say: Be careful that the money does not end up in your brother’s hands, where he would waste it by buying cigarettes.
