The Shaykh : And accordingly, the benefit of His saying:
Above فوق
is to indicate that the fixed share does not increase with their increase.
Now, then Allah the Exalted said:
And if there is only one, for her is half وإن كانت واحدة فلها النصف
[An-Nisa 4:11]
the one has the half.
And it is known from His saying:
And if there is only one, for her is half واحدة فلها النصف
[An-Nisa 4:11]
that there is no son with her, because if there were a son with her, it would fall under His saying:
for the male, what is equal to the share of two females للذكر مثل حظ الأنثيين
[An-Nisa 4:11]
.
So this verse indicates that the descendants are either males or females, and their inheritance is not fixed, because it is by agnation, for the male has the share of two females. If they are females only, the one has the half, and what exceeds that for them is two-thirds.
If they are pure males, their inheritance is not fixed, it is by agnation, because if a male shares with a female, he makes her an agnate, so how much more so if they are males? It is by agnation, a fortiori.
So the heirs now, the descendants, are in three categories:
Pure males, and second, pure females, and third, males and females.
The pure males and the females with the males inherit by agnation, and the pure females by fixed share, the one has the half and what exceeds that is two-thirds.
