Chapter: The Combatants from Among the People of Disbelief and Apostasy. And the saying of Allah the Exalted:
Indeed, the penalty for those who wage war against Allah and His Messenger and strive upon earth [to cause] corruption is none but that they be killed or crucified or that their hands and feet be cut off from opposite sides or that they be exiled from the land إنما جزاء الذين يحاربون الله ورسوله ويسعون في الأرض فسادا أن يقتلوا أو يصلبوا أو تقطع أيديهم وأرجلهم من خلف أو ينفوا من الأرض
[Al-Ma'idah 5:33]

The Shaykh : ... corruption in the land, in terms of the disruption of security caused by them, because a person does not feel safe for himself or his property if armed people are threatening him and taking his money.
And His saying:
The only recompense ... that they be killed إنما جزاء ... أن يقتلوا

And as we see in the noble verse, it contains four punishments:
That they be killed, or crucified, or their hands and feet be cut off from opposite sides, or they be exiled from the land.

the scholars differed regarding this: is it for variety or for choice?
The difference between them is that if we say it is for variety, these become varied punishments according to the crimes, and the Imam has no choice in them.
And if we make it for choice, it becomes subject to the Imam's choice, and if it is subject to his choice...
