Question:
In the last of the questioner Tahir Adam from Ghana in West Africa, he inquires about the noble verse, O Shaykh, he says: What is the meaning of the saying of Allah the Exalted: [Al-Ma'idah: 33]? He says: And what is the reason for the revelation of this verse?
Answer:
This was revealed regarding those who wage war, who are the highway robbers who harm people on the roads, killing them and looting their wealth on the roads, or in the town. These are the ones to whom this ruling applies. It was revealed regarding the 'Uraynah who complained of stomach ailments, and the Prophet (peace and blessings be upon him) directed them to go out to the camels of zakah to stay with them. When they recovered, they killed the Prophet's (peace and blessings be upon him) shepherd, took the camels, and scattered them. The Prophet (peace and blessings be upon him) sent an army after them, and they caught up with them, took the camels from them, and captured them. So the Prophet (peace and blessings be upon him) punished them with this punishment because they were highway robbers who had encroached upon the camels of the Prophet (peace and blessings be upon him).
These are called: those who wage war, and they are called: highway robbers. The one in authority has the choice: if he wishes, he kills them; if he wishes, he crucifies them; if he wishes, he cuts off their hands and feet from opposite sides; and if he wishes, he exiles them from the land. This is up to the one in authority. If they have killed, they are killed. If they have taken wealth, if he wishes, he kills them; if he wishes, he cuts off their hands and feet from opposite sides; and if he wishes, he crucifies them. This is for the one in authority. The one in authority exercises independent legal reasoning in what he sees as the public benefit for the Muslims.
They are called: those who wage war, and they are called: highway robbers. And their exile from the land: some of the scholars said: this means imprisoning them so that they do not harm people. And others among the scholars said: they are driven out; they are not allowed to settle in a town. Whenever they settle in a town, they are driven out of it until they repent with a sincere repentance. Yes.

Indeed, the penalty for those who wage war against Allah and His Messenger and strive upon earth [to cause] corruption is none but that they be killed or crucified or that their hands and feet be cut off from opposite sides or that they be exiled from the land. That is for them a disgrace in this world; and for them in the Hereafter is a great punishment,
