The reciter: And Habib ibn Abi Ummarah said, from Sa'id, from Ibn Abbas, who said: The Prophet (peace and blessings be upon him) said to al-Miqdad:
If a man who was hiding his faith with a group of disbelievers reveals his faith, and you kill him, then it is as if you had been hiding your faith in Mecca before إذا كان رجل ممن يخفي إيمانه مع قوم كفار ، فأظهر إيمانه فقتلته ، فكذلك كنت أنت تخفي إيمانك بمكة من قبل


The Shaykh : This also contains a warning against whoever kills a protected soul, because the Messenger said:
I f you kill him, he will become like you before you kill him and you will become like him before he uttered his credo which he has uttered now. إن قتلته فإنه بمنزلتك قبل أن تقتله وأنت بمنزلته قبل أن يقول كلمته التي قالها
Sunan Abi Dawud 2644Sahih (Al-Albani)
meaning that your killing of him is disbelief, just as it came in the hadith:
Abusing a Muslim is an outrage and fighting against him is unbelief سباب المسلم فسوق وقتاله كفر
Sahih Muslim 64a
So if one makes permissible the killing of a Muslim, he is a disbeliever with a disbelief that takes him out of the religion. Yes.
