The reciter: Qutaybah ibn Sa'id narrated to us, Layth narrated to us. And Muhammad ibn Rumh narrated to us, and the wording is similar. Layth informed us from Ibn Shihab from 'Ata ibn Yazid al-Laythi from 'Ubayd Allah ibn 'Adi ibn al-Khiyar from al-Miqdad ibn al-Aswad that he informed him that he said:
O Messenger of Allah, what do you think if I encounter a man from among the disbelievers and he fights me, and he strikes one of my hands with a sword and cuts it off, and then he flees from me to a tree and says, "I have submitted to Allah"? Should I kill him, O Messenger of Allah, after he has said that? The Messenger of Allah (peace and blessings be upon him) said: Do not kill him. He said: I said: O Messenger of Allah, he has cut off my hand, and then he said that after cutting it off. Should I kill him? The Messenger of Allah (peace and blessings be upon him) said: Do not kill him. If you kill him, he is in the same position as you were before you killed him, and you are in the same position as he was before he said the word he said. يا رسول الله ، أرأيت إن لقيت رجلا من الكفار فقاتلني ، فضرب إحدى يدي بالسيف فقطعها، ثم لاذ مني بشجرة ، فقال : أسلمت لله ، أفأقتله يا رسول الله ، بعد أن قالها ؟ قال : رسول الله صلى الله عليه وسلم: لا تقتله قال :فقلت : يا رسول الله ، إنه قد قطع يدي ، ثم قال ذلك بعد أن قطعها ، أفأقتله ؟ قال رسول الله صلى الله عليه وسلم: لا تقتله ، فإن قتلته فإنه بمنزلتك قبل أن تقتله ، وإنك بمنزلته قبل أن يقول كلمته التي قال

That is, does he demand that his hand be cut off as his was cut off? The matter is hypothetical, not a reality. We say: No. This is because the actions of the disbeliever against the Muslims and their property during war are not guaranteed, just as our actions against them are not guaranteed.
