The Shaykh : As for this chapter: "The Chapter of the Deceased Being Punished by the Weeping of His Family Over Him," the scholars differed in deriving this ruling from the following hadiths. This is because it is known with necessity from the religion, and from the covenant of Allah (Mighty and Majestic), that no bearer of a burden will bear the burden of another, and that a person is not punished for the deed of another. So how is the deceased punished by the weeping of his family?
The scholars (may Allah have mercy on them) differed in deriving this hadith. Some said: The intended meaning is the deceased who left a will regarding this, meaning he instructed his family to weep over him, so he is punished because he left a will for something forbidden, and its punishment befalls him. Others said: This applies to one who was pleased with it, even if he did not leave a will, such as one who knows that it is the custom of his family to weep and does not forbid them from doing so. Others derived it in a good manner, saying: The punishment intended here is not the punishment of retribution, for the punishment of retribution cannot be inflicted on anyone other than the doer. Rather, the intended meaning of punishment is distress, the distress of a person, his worry, and his grief, and this occurs without sin. This is like the saying of the Messenger of Allah (peace and blessings be upon him):
Travel is a portion of the punishmentالسّفر قطةٌ من العذاب
, and it is known that travel is not a punishment. This is what the Shaykh al-Islam (may Allah have mercy on him) chose, as I believe, and it is the correct view: that the intended meaning of punishment here is worry, grief, regret, and the like, and not the punishment of retribution.
