الشيخ : الترجمة ، باب جواز اشتراط المحرم التّحلّل بعذر المرض ونحوه ، وذلك عند عقد الإحرام ، إذا كان الإنسان مريضًا ويخشى أن لا يتم نسكه فإن الأفضل أن يشترط ، ويقول بلسانه : إن محلي -أي : مكان حلولي أو زمن حلولي- حيث حبستني ، يخاطب ربه عز وجل ، لأنه سيقول : لبيك اللهم لبيك لبيك ، لا شريك لك لبيك ومحلي حيث حبستني .
وعلم من الترجمة أن غير الخائف لا يستثني ، ولا يشترط وهو كذلك ، وهذا هو الذي تجتمع به الأدلة ، لأن النبي صلى الله عليه وسلم أحرم ولم يشترط ، وأرشد ضباعة عمته ، ضباعة بنت الزبير بن عبد المطلب أرشدها إلى أن تشترط .
وقد انقسم العلماء في هذه المسألة إلى ثلاثة أقسام : منهم من قال ينبغي أن يشترط بكل حال .
ومنهم من قال : لا يشترط بكل حال .
ومنهم من فصّل وقال : الخائف ألا يتم نسكه يشترط ، وغيره لا يشترط ، ولا شك أن هذا هو الذي يجمع بين الأدلة ، ووجه ذلك أن النبي صلى الله عليه وسلم لم يشترط ، وأنه أرشد ضباعة بنت الزبير إلى أن تشترط لأنها ذكرت أنها وجعة ، فخافت ألا تتم .
وهل مثل ذلك إذا خافت المرأة أن تحيض وهي في عمرة ، وتخشى أن تحيض فتنحبس وتحبس أهلها ؟
الجواب : نعم مثل ذلك من كانت تخشى أن يأتيها الحيض قبل إتمام النسك فتشترط وتنوي الحيض .
فإن قال قائل : وهل مثل ذلك إذا خاف أن يفوته الوقوف بعرفة ؟ نعم ، يجوز إذا خاف أن يفوته الوقوف بعرفة أن يشترط ، فيقول : إن حبسني حابس فمحلي حيث حبستني ، فمتى فاته الوقوف تحلل بدون شيء .
والحائض كما قلت لكم إذا كانت تخشى أن يأتيها الحيض قبل أن تحل من إحرامها فلها أن تشترط ،
الحائض إذا كانت تخشى ، المرأة إذا كانت تخشى الحيض ، فإنها تشترط . Whoever fears that menstruation will come to her before completing the rites makes a condition and intends menstruation. If someone asks: Is it like that if he fears that standing at 'Arafah will be missed from him? Yes, it is permissible if he fears that standing at 'Arafah will be missed from him to make a condition, and he says: “If a detainer detains me, then my place of completion is where I am detained.” So whenever standing at 'Arafah is missed from him, he exits the state of ihram without anything. And the menstruating woman, as I told you, if she fears that menstruation will come to her before she exits the state of ihram, then she has the right to make a condition.
