The reciter: And Ibn Abi Umar narrated to us, he said: Hisham ibn Sulayman al-Makhzumi and 'Abd al-Majid narrated to us from Ibn Jurayj, from Nafi', from Ibn 'Umar, he said: Hafsa (may Allah be pleased with her) told me: .
The Shaykh : The apparent meaning of this hadith supports the view held by some scholars that exiting the state of ihram must be by slaughtering, and that shaving is not a condition for it, because the Prophet (peace and blessings be upon him) slaughtered before he shaved. However, what appears to me, and Allah knows best, is that the Prophet's (peace and blessings be upon him) expression with this was in accordance with the verse, which is His saying, the Exalted:[Al-Baqarah 2:196], whereas in the verse there is an indication that the intended meaning is not slaughtering, because of His saying: [Al-Baqarah 2:196] meaning: the time of its arrival. For this reason, the Sunnah came with the precedence of slaughtering over shaving, and the permissibility of shaving before slaughtering. The Sunnah also came with the precedence of slaughtering over circumambulation, and the permissibility of circumambulation before slaughtering.
So the apparent meaning, and Allah knows best, is that the saying of the Messenger (peace and blessings be upon him) was in following the verse, otherwise exiting the state of ihram does not occur except when one shaves.
If someone were to say: If we agree that exiting the state of ihram must be by shaving, then on this basis, one does not exit the state of ihram except when he has stoned the pillars, slaughtered, and shaved?
We say: If that were said, it would have a valid aspect, and this may be answered by saying: There is a difference between the one who brought the sacrificial animal.
That the Prophet (peace and blessings be upon him) ordered his wives to exit the state of ihram during the year of the Farewell Pilgrimage. Hafsa said: I said: What prevents you from exiting the state of ihram? He said: I have applied oil to my head, and put the collar on my sacrificial animal, so I will not exit the state of ihram until I slaughter my sacrificial animal.
The Shaykh : The apparent meaning of this hadith supports the view held by some scholars that exiting the state of ihram must be by slaughtering, and that shaving is not a condition for it, because the Prophet (peace and blessings be upon him) slaughtered before he shaved.
