The questioner : His third and final question asks: What is the ruling on a man who kisses a woman and does everything with her except fornication, and what is the expiation for that? We ask your Excellency to guide us to books that mention this, as many of the young men in our village are afflicted with this. My intention is to advise them. Please inform us. May Allah reward you with the best reward and assist you in spreading the call of His Prophet Muhammad (peace and blessings be upon him).
The Shaykh : This act you mentioned, O questioner, is forbidden for them, for Allah the Exalted says:[Al-Mu'minun 23:5-7].
The questioner : Yes.
The Shaykh : And He, Glorified and Exalted is He, says:[Al-Isra 17:32]. So reflect on His saying: . He did not say "Do not commit fornication" so that this would encompass everything that is a cause or means to fornication.
The questioner : Yes.
The Shaykh : And what they did is of the fornication of the hand through touching, of the fornication of the eye through looking, and of the fornication of the private part through walking. This is forbidden for them, and they must repent from it. It is obligatory for the rulers to impose discretionary punishment on these people and discipline them in a way that deters them and their like, and prevents them from this sin.
The questioner : Yes.
The Shaykh : The Messenger (peace and blessings be upon him) did not forbid seclusion with a non-mahram woman except out of fear of this and its like. So you, may Allah guide you, advise them with what is obligatory upon you and warn them of this.
As for the books that mention this, they are the books of tafsir, the books of hadith, and the books of fiqh, all of which, praise be to Allah, explicitly state the prohibition of this matter and that it is not permissible and not lawful.
The questioner : Yes.
The Shaykh : This act you mentioned, O questioner, is forbidden for them, for Allah the Exalted says:
(5) And they who guard their private parts (6) Except from their wives or those their right hands possess, for indeed, they will not be blamed - (7) But whoever seeks beyond that, then those are the transgressors -
والذين هم لفروجهم حافظون إلا على أزواجهم أو ما ملكت أيمانهم فإنهم غير ملومين فمن ابتغى وراء ذلك فأولئك هم العادونThe questioner : Yes.
The Shaykh : And He, Glorified and Exalted is He, says:
And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way.
ولا تقربوا الزنا إنه كان فاحشة وساء سبيلاAnd do not approach fornication.
