The Shaykh : He says: One of the scholars mentioned that the second congregation after the first is not permissible, and mentioned that the majority are of this opinion, and mentioned a statement by al-Shafi'i that supports this view. He said: Some of the Companions (may Allah be pleased with them), when they missed the first congregation, would pray individually. What is the validity of this opinion? The answer: If the second congregation is customary, such that they are accustomed to establishing two congregations in this mosque without necessity, then it is a religious innovation (bid'ah) and is forbidden. However, if it is due to an unforeseen circumstance, such as a group entering after they have missed the prayer, then they pray in congregation. This is based on evidence, including: A man entered while the Prophet (peace and blessings be upon him) was with his Companions, and he said: "Who will give charity to this man by praying with him?" So one of the Companions stood up and prayed with him. This is a second congregation after the first. Also, the hadith of Abu ibn Ka'b that the Prophet (peace and blessings be upon him) said: "The prayer of a man with another man is purer than his prayer alone, and his prayer with two men is purer than his prayer with one man, and the more there are, the more beloved it is to Allah." Also, it is narrated from a group of Companions, such as Ibn Mas'ud (may Allah be pleased with him), as transmitted by the author of al-Mughni. He transmitted from him that he entered the mosque with his Companions and established a congregation with them. Another narration is reported from him that he left and prayed in his house, meaning Ibn Mas'ud. This is understood to be a specific case for him, perhaps he went to his house for fear that people would follow his example and say: "This is the companion of the Messenger of Allah (peace and blessings be upon him) who missed the congregation," and people would become negligent, or he feared that the imam would be criticized, thinking that he delayed so as not to pray behind this imam, or for another purpose. As for the mosques that are on the roads, where travelers come, this congregation prays and then leaves, then the next one prays and then leaves. Al-Nawawi said that there is no dislike in this by consensus. Therefore, the categories are three: a religious innovation (bid'ah), permissible by consensus, and a matter of scholarly disagreement. The correct view is that it is established.
