The Shaykh : We say that if one catches the end of the imam's prayer and stands to make up what he missed, the scholars have differed on whether what he makes up is the beginning of his prayer or the end of his prayer. Some scholars say that if the masbuq stands to make up after his imam, he makes up the beginning of his prayer. On this view, he recites al-Fatihah and recites a surah after al-Fatihah, because these two rak'ahs that he is making up are the beginning of his prayer.

The Shaykh : And some of them say that what he makes up is the end of his prayer, based on the saying of the Prophet (peace and blessings be upon him):

meaning He completed them. And as in His saying:
and then decreed a term and a specified time [known] to Him ثم قضى أجل وأجل مسمى عنده
[Al-An'am 6:2]
meaning He completed it and brought it to an end.

The Shaykh : Therefore, we say that the correct view is that what the masbuq makes up is the end of his prayer, not the beginning. This is clearly indicated by the fact that if he catches the last rak'ah of the Maghrib prayer and then stands to make up, he sits for the first tashahhud when he prays one rak'ah. If what he makes up were the beginning of his prayer, he would not sit for the first tashahhud in the first rak'ah.
