Review and Discussion under the Chapter of Vessels

Machine translationRead the Arabic original
The Shaykh : Has the time run out? And upon his Family and his Companions, and those who follow them with excellence until the Day of Judgment. What has become clear to us from the previous hadiths regarding the ruling on drinking from vessels of gold and silver? Is it a major sin or a minor sin?
The student: It is a major sin.

The Shaykh : Why?
The student: Because a warning is attached to it.

The Shaykh : Because a warning is attached to it, and the principle among the scholars is that anything to which a warning is attached is among the major sins. Now, what if Muhammad Hamid drank from a diamond vessel?
The student: ...

The Shaykh : ...
The student: It is permissible.

The Shaykh : A diamond vessel?
The student: Permissible.

The Shaykh : Which is more expensive, diamond or silver?
The student: Diamond is more expensive.

The Shaykh : Now, how can it be permissible when silver is forbidden?
The student: Because the Messenger of Allah (peace and blessings be upon him) specified the cause, stating that vessels of gold and silver are for the disbelievers in this world and for us in the Hereafter.

The Shaykh : And what remains for everything else is?
The student: ...

The Shaykh : No, and everything else remains on the original ruling.
The student: On the original ruling.

The Shaykh : And he?
The student: Permissibility.

The Shaykh : And that is permissibility. Now, if it is considered that using water in this... specific case is wasteful... brother?
The student: I am.

The Shaykh : I mean you, did you not attend?
The student: No.

The Shaykh : I mean, now, yes?
The student: Even if it were so.

The Shaykh : If it is considered to be wasteful in the case of a specific person?
The student: Yes, even if it were considered so.

The Shaykh : Is it permissible?
The student: Yes.

The Shaykh : Yes, that is right?
The student: It is not permissible.

The Shaykh : It is not permissible. Why?
The student: ...

The Shaykh : The evidence? Give me the evidence?
The student: ...

The Shaykh : The evidence is the saying of Allah the Exalted:
And be not excessive. Indeed, He does not like those who commit excess. ولا تسرفوا إنّه لا يحبّ المسرفين
[Al-An'am 6:141]
Correct. And on this, people differ. Some people, perhaps if they use diamond, we say it is not forbidden, and others say it is forbidden.
In the hadith of Ibn Abbas:
When the skin is tanned it becomes purified. إذا دبغ الإهاب فقد طهر
Sahih Muslim 366a
Any skin tanned, then it has been made pure وأيّما إهاب دبغ فقد طهر
Jami` at-Tirmidhi 1728Sahih (Darussalam)
and
The tanning of a dead animal’s skin purifies it دباغ جلود الميتة طهورها
Bulugh al-Maram 19
and
Water and qirḍ purify it يطهّرها الماء والقرظ
What is the cause of these hadiths? Yahya?
The student: Yes.

The Shaykh : What is the cause of these hadiths?
The student: The disagreement of the scholars...

The Shaykh : What is their cause? I am not asking what their ruling is?! The cause of the hadith?
The student: Its cause is that the Prophet (peace and blessings be upon him)...

The Shaykh : ...
The student: It is more comfortable for you.

The Shaykh : ... except if he has two wives.
The student: Hehehe.

The Shaykh : Here...
The student: By Allah, O Shaykh, in the papers my name is Mas'ud, but my popular name is Abd al-Hamid because the family calls me Abd al-Hamid.

The Shaykh : ...
The student: It is that the Prophet (peace and blessings be upon him) was passed a sheep dragging... and he said, if you took...

The Shaykh : If you took its hide.
The student: Its hide, yes.

The Shaykh : Now, so the cause is that the Messenger of Allah (peace and blessings be upon him) saw a sheep dragging, and it was dead... its hide, and they said it was carrion, so the hadiths came with this, and the wordings differed based on the difference of the narrators. How do the scholars differ in the ruling of this issue, Sharafi?
The student: ...

The Shaykh : Yes.
The student: ...

The Shaykh : ... on the famous opinions... yes, that is right.
The student: Some of them said that tanning does not purify absolutely.

The Shaykh : Yes.
The student: And some of them said it purifies absolutely.

The Shaykh : Yes.
The student: ...

The Shaykh : Yes, these are the roots of the disagreement. The roots of the opinions in it are that it purifies absolutely, or it does not purify absolutely, or there is a detailed ruling. Now, based on the opinion that every hide that is tanned becomes pure, if a person tanned the skin of a donkey, Samih?
The student: It becomes pure.

The Shaykh : It becomes pure?
The student: Yes.

The Shaykh : And it is used for everything?
The student: And it is used for everything.

The Shaykh : Yes, and based on the opinion that it does not purify, if he tanned the skin of a dead sheep, Ibrahim?
The student: It is permissible to use it.

The Shaykh : Yes?
The student: Because tanning reduces the impurity.

The Shaykh : Now, the stronger opinion in my view is that it does not purify except what is made lawful by ritual slaughter, meaning the skin of carrion does not become pure unless it is made lawful by ritual slaughter, because it would be like a garment that becomes impure and then is purified. As for what is impure in its essence from the original creation, it does not become pure by tanning. This is the closest of the opinions to me, and Allah knows best.
We take the new lesson now: " And from Abu Thalhah al-Khushni (may Allah be pleased with him) who said:
I said: O Messenger of Allah, we are in the land of a people of the Book, so should we eat from their vessels? He said: Do not eat from them unless you find nothing else, then wash them and eat from them قلت: يا رسول الله إنا بأرض قوم أهل كتاب أفنأكل في آنيتهم؟ قال: لا تأكلوا فيها إلا أن لا تجدوا غيرها فاغسلوها وكلوا فيها
Agreed upon by al-Bukhari and Muslim "
.
The student: ...

The Shaykh : ... Glory be to Allah! Are they all related to skin?
