Review and Discussion under the Chapter on Things That Invalidate Wudu

Machine translationRead the Arabic original
The student: May Allah reward you, O Shaykh: What about a woman who has purified herself from post-natal bleeding, and after thirty days have passed, after the thirty days?

The Shaykh : A moment, because you reminded me. He says, an important benefit: his statement:
Then he prayed ثم صلى
Does he mean the upcoming prayer, the current prayer, or both?
I mean, a woman who purified herself during the time of the Fajr prayer, after the dawn had appeared. Do we say: Pray, meaning pray the Zuhr, or pray the Fajr?
The student: She prays the Fajr.

The Shaykh : She prays the Fajr, even if her purification is delayed until after the sun has risen, because she must pray the Fajr, as she is obligated to pray.
But what is the amount by which she catches the time of the prayer?
The school of thought says by the amount of the opening takbir. So if she purifies herself before the sun rises by the amount of saying: Allahu Akbar, it is obligatory for her to pray the Fajr. And the correct view is that one does not catch the time except by catching a complete rak'ah, based on the saying of the Prophet (peace and blessings be upon him):
Whoever catches a raka of the prayer has caught the prayer. من أدرك ركعة من الصلاة فقد أدرك الصلاة
Muwatta Malik 1:15
. Then, if she purifies herself, this branches out:
If she purifies herself during the time of the prayer, is she obligated to make up what came before it?
There is a detail: If what came before it cannot be combined with it, then she does not make it up. For example, if she purifies herself during the time of the Zuhr, she does not make up the Fajr prayer, because the Fajr is not combined with the Zuhr. And if it can be combined, for example, if she purifies herself during the time of the 'Asr, does she make up the Zuhr or not?
There is disagreement among the scholars, and the correct view is that she does not make up the prayer, because the time for the Zuhr has passed and she was excused, not addressed with the prayer. And the fact that this prayer is combined with that one in case of necessity does not mean that it is obligatory for her, and her liability is cleared. Her time has passed and her liability is cleared.
Then the saying of the Messenger (peace and blessings be upon him):
Whoever catches a rak'ah من أدرك ركعة
or he said:
a prostration of 'Asr before the sun sets, then he has caught up with it سجدة من العصر قبل أن تغرب الشمس فقد أدرك العصر
Sunan an-Nasa'i 550Sahih (Darussalam)
: and he did not say: and the Zuhr. So the correct view is that she is not obligated to make up anything except the prayer in whose time she purified herself.
Now, a woman who purified herself an hour before the Fajr, is she obligated to pray the 'Isha?
There is disagreement: Some scholars say: She is obligated to pray the 'Isha but not the Maghrib prayer. And some scholars say: She is obligated to pray the 'Isha and the Maghrib prayer. And the correct view is that she is not obligated to pray either the 'Isha or the Maghrib, because the time for the 'Isha ends at half the night, and there is no evidence that it extends to the appearance of the dawn, neither in the Qur'an nor in the Sunnah. Rather, the evidence is to the contrary. Allah the Exalted said:
Establish prayer at the decline of the sun [from its meridian] until the darkness of the night أقم الصلوة لدلوك الشمس إلى غسق الليل
[Al-Isra 17:78]
Then He specified and said:
And the recitation of the dawn. وقرآن الفجر
.
And establish prayer at the decline of the sun وأقم الصلوة لدلوك الشمس
Meaning: for its setting
until the darkness of the night إلى غسق الليل
from midday to midnight. This is the time for four prayers, two by day and two by night.
Now, then He specified and said:
And the recitation of the dawn. وقرآن الفجر
.
As for the Sunnah, it is explicit. The Prophet (peace and blessings be upon him) said:
the, time of the night prayer (lasts) by midnight وقت العشاء إلى نصف الليل
Sahih Muslim 612b
: And this is an explicit and clear text. And glory to Allah, that a person sometimes sees the evidence as clear as the sun, and the opinion of most of the scholars, or many of them, is contrary to it, which indicates that a person, no matter who he is, is a place of deficiency.
So if someone says: The hadith has come from the Prophet (peace and blessings be upon him) that he said:
There is no negligence in sleep, but negligence is to delay a prayer until the time of the next one enters ليس في النوم تفريط ، وإنما التفريط أن يؤخر صلاة حتى يدخل وقت الأخرى
?
We say: Yes, and we say this, and what is meant by the prayer whose time extends to the time of the other. Otherwise, say: That the Fajr and the Zuhr are like the Maghrib and the 'Isha. And no one holds this view. And the wisdom also requires what we said, because Allah the Exalted made the first half of the day not a time for the obligatory prayers, and the second half of the night not a time for the obligatory prayers.
The student: A woman now.

The Shaykh : Not the one who covered you.
