First of all, it is disbelief, kufr, and among their actions is killing. So those who kill those who enjoin justice among the people have taken from the actions of these disbelievers the act of killing, but this does not necessitate that they are disbelievers, because killing a soul does not necessitate disbelief, as Allah the Exalted said:
But whoever overlooks from his brother anything, then there should be a suitable follow-up and payment to him with good conduct فمن عفي له من أخيه شيء فاتباع بالمعروف وأداء إليه بإحسان
[Al-Baqarah 2:178]
Is this a brother in Islam, O Shaykh? Yes? This is a brother in Islam, and this one kills the one who enjoins justice. Is this not his enemy? Yes, yes. In any case, he is not declared a disbeliever, unless his action is out of hatred for the truth, and that is a different matter.

The questioner : The one who declares sins? How? He openly commits sins? And what does it mean to openly commit? Does it mean the action they perform?

The Shaykh : We mentioned during the tafsir that Allah ordered His Prophet to give them tidings of a painful punishment. It is possible that this is a ruling for them, and it is possible that Allah ordered him to say that. And we mentioned that this is looked at in terms of maslahah (public benefit).

The questioner : Shaykh, the general rule is that those who kill those who enjoin justice among the people do not kill them for their persons only, but rather for this methodology they follow, yes, correct. So did they disbelieve?
The Shaykh : But we do not declare them disbelievers unless we know, because they may kill them for another reason. Is the intention of everyone who enjoins justice among the people good? There are now people who enjoin justice among the people to reach power, and when they reach power, they become more wicked than those who spoke about them. So these issues are delicate, they are not easy, yes.
