Continuation of the Discussion

The Shaykh :
Lawful to you is game from the sea and its food أحل لكم صيد البحر وطعامه حل لكم
[Al-Ma'idah 5:96]
What is the indication in the verse?
The student: Ibn 'Abbas said that the catch of the sea is what is taken alive, and its food is what is taken dead.

The Shaykh : Well done. Likewise, the story of the detachment that found ambergris, and the Prophet (peace and blessings be upon him) approved their eating of it.

The Shaykh : What is the evidence that the carrion of locusts is lawful?
The student: The saying of the Prophet (peace and blessings be upon him) in a hadith:
Two types of dead animals and two types of bloods have been made lawful for us, the two types of dead animals are locusts and fish (seafood), while the two types of bloods are the liver and the spleen أحل لنا ميتتان ودمان فأما الميتتان فالجراد والحوت وأما الدمان فالكبد والطحال
Bulugh al-Maram 13

The Shaykh : His saying: "locusts." Some scholars have criticized this hadith for being weak when attributed to the Prophet, and this criticism is flawed. Because if we say it is not attributed to the Prophet, it is a report stopping at a Companion, which is treated as if attributed to the Prophet. Because when Ibn 'Umar says "lawful," he means the Messenger (peace and blessings be upon him).

The Shaykh : Blood?
The student: Blood in general is qualified in Surat al-An'am as "poured-out blood."

The Shaykh : Well done. The intended meaning is poured-out blood, which is qualified by the verse in Surat al-An'am.

The Shaykh : Is the blood that remains in the veins after slaughter lawful or forbidden?
The student: Lawful.

The Shaykh : Lawful?
The student: Yes, the blood that is in the liver.

The Shaykh : No, in the veins after slaughter?
The student: It is forbidden.

The Shaykh : After slaughter?
The student: Lawful, O Shaykh.

The Shaykh : Do you agree with this?
The student: Yes,

The Shaykh : Yes, all blood after the animal is slaughtered is lawful. That means you can take a vein and suck it after you have slaughtered the animal.

The Shaykh : There is a lot of blood in the heart. What is its ruling? Is it permissible to eat it? Is it permissible to eat it?
The student: It is not permissible. Only the liver is permissible to eat.

The Shaykh : Salim, what do you say? Even if the whole heart is left, but our discussion is whether it is lawful to eat it or not?
Is it lawful? Is it poured-out blood? It is not poured-out blood. Blood after the animal is slaughtered is lawful, there is no problem with it.

The Shaykh :
The flesh of the pig لحم الخنزير
Clear.

The Shaykh :
that which has been dedicated to other than Allah ما أهل لغير الله به
[Al-Ma'idah 5:3]
What does it mean?
The student: What was slaughtered for other than Allah.

The Shaykh : What was mentioned with the intention of Allah?
The student: No, what was slaughtered for other than Allah.

The Shaykh : Wrong. It is what the name of other than Allah was mentioned over it. For example, if one says: "In the name of Jesus," "In the name of Muhammad," "In the name of the king," "In the name of the president," "In the name of the minister," it becomes forbidden, even if it is not for worship?
The student: Even if it is not for worship.

The Shaykh : Well done. May Allah reward you.

The Shaykh :
[those animals] killed by strangling or by a violent blow or by a head-long fall or by the goring of horns المنخنقة والموقوذة والمتردية والنطيحة
[Al-Ma'idah 5:3]
Is it not from the carrion?
The student: Yes, it is from the carrion.

The Shaykh : What is the wisdom in Allah specifying it?
The student: To emphasize it.
The student: These things can be caught, but carrion cannot be caught.

The Shaykh : That is, for the exception, due to His saying:
Prohibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and [those animals] killed by strangling or by a violent blow or by a head-long fall or by the goring of horns, and those from which a wild animal has eaten, except what you [are able to] slaughter [before its death], and those which are sacrificed on stone altars, and [prohibited is] that you seek decision through divining arrows. That is grave disobedience. This day those who disbelieve have despaired of [defeating] your religion; so fear them not, but fear Me. This day I have perfected for you your religion and completed My favor upon you and have approved for you Islam as religion. But whoever is forced by severe hunger with no inclination to sin - then indeed, Allah is Forgiving and Merciful. إلا ما ذكيتم
[Al-Ma'idah 5:3]
And these descriptions are descriptions of the cause of death.

The Shaykh : What is the difference between the strangled and the beaten to death?
The student: The strangled is the one that died by strangulation, and the beaten to death is the one that died by beating.

The Shaykh : That is, the strangled is the one that was smothered until it was strangled and did not breathe, and the beaten to death is the one that died by beating.

The Shaykh : Does the fallen one include one that falls into a well?
The student: It includes it.

The Shaykh : So falling is from high to low, meaning whether it fell from above to the ground or from the ground to below, every fallen one.

The Shaykh : What do you say about the one run over? It was run over by a car, is it lawful or forbidden?
The student: Forbidden, except what you slaughter.

The Shaykh : And what is closest in meaning to what Allah mentioned?
The student: The beaten to death.

The Shaykh : The beaten to death?
The student: Yes.

The Shaykh : Yes, very well.

The Shaykh : His saying, Exalted is He:
Prohibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and [those animals] killed by strangling or by a violent blow or by a head-long fall or by the goring of horns, and those from which a wild animal has eaten, except what you [are able to] slaughter [before its death], and those which are sacrificed on stone altars, and [prohibited is] that you seek decision through divining arrows. But whoever is forced by severe hunger with no inclination to sin - then indeed, Allah is Forgiving and Merciful. إلا ما ذكيتم
[Al-Ma'idah 5:3]
From what is it excepted?
The student: It is excepted from what came before, which can be caught.

The Shaykh : and it is?
The student: That is, everything that can be caught from what came before.

The Shaykh : As for the pig, it is forbidden because of its type, not because of the cause of its death.
The student: His saying, Exalted is He:
This day I have perfected for you your religion اليوم أكملت لكم دينكم
[Al-Ma'idah 5:3]
What is the intended meaning of this day?

The Shaykh : I want you to clarify, what is the intended meaning of the day
This day I have perfected for you اليوم أكملت لكم
[Al-Ma'idah 5:3]
?
The student: The Day of 'Arafah.

The Shaykh :"Al" in His saying:
the Day اليوم
?
The student: For the present definite article.

The Shaykh : His saying:
This day I have perfected for you your religion اليوم أكملت لكم دينكم
[Al-Ma'idah 5:3]

The student: Yes, it came to them complete.

The Shaykh : Is it a response to this that Allah the Exalted revealed after this verses containing rulings?
The student: It is a response to this.

The Shaykh : How do you reconcile them?
The student: They were revealed on the Day of 'Arafah.

The Shaykh : They were revealed at 'Arafah, and verses containing rulings were revealed after that. Do we say that everything that came from the revelation of verses after this is not correct?
The student: No.

The Shaykh : So how do we reconcile them with His saying:
Today I have perfected اليوم أكملت
?
The student: There is no problem with it. The day here, we said the intended meaning is the completion of the religion. That does not necessitate that this religion was completed on this day on which this verse was revealed.

The Shaykh : Yes, correct. That is, explaining that the religion is complete, and it does not have to be finished. For this reason, he distinguished and said:
This day I have perfected for you your religion and completed My favor upon you اليوم أكملت لكم دينكم وأتممت عليكم نعمتي
[Al-Ma'idah 5:3]
.

The Shaykh : His saying:
And whoever is compelled فمن اضطر
What does it mean?
The student: Necessity overtook him.

The Shaykh : In what sense?
The student: That is, necessity overtook him to eat this carrion.

The Shaykh : That is, if he did not eat, he would be harmed.

The Shaykh : We mentioned that the forbidden does not become lawful for necessity except with two conditions?
The student: The first is that he is not inclined to sin, meaning he does not want to eat this.

The Shaykh : No, that is, when is the necessity to do the forbidden true?
The student: If he does not eat from the forbidden, he is harmed.
The student: The two conditions. The first: that the harm arises from this matter so he finds nothing else. The second: that his harm is removed by this forbidden thing.

The Shaykh : Well done, this is important. That there is nothing to repel the necessity except this, because if there were, he would not be in necessity. And the second: that his necessity is removed by it. We only stipulated this so that someone would not say: "Then it is permissible to treat with the forbidden." We say: It is not permissible to treat with the forbidden. Do you understand, everyone? Why? First, because he is not compelled to it, as his illness may be removed by another medicine, or his illness may be removed without medicine. How many people reached the lowest state, then Allah, Mighty and Majestic, cured them without any cause. And the second: that his necessity is not removed by this medicine, as a person may treat himself and not be cured, unlike one who eats the forbidden due to hunger. If a person finds, for example, nothing but carrion, his necessity cannot be removed except by eating it. And if he eats, is it removed or not?
The student: It is removed.

The Shaykh : It is removed, yes. If he eats, he fills his stomach and it ends. Have we completed the verse? There are remaining benefits. Have we not taken the benefits? Yes.

The Shaykh : What is al-mukhmasah?
The student: Famine.

The Shaykh : Do you have a witness that it is famine?
The student: The saying of the Prophet (peace and blessings be upon him):
If you were to put your trust in Allah as you should, you would be given provision like the birds: they go out hungry in the morning and come back with full bellies in the evening. لو توكلون على الله حق توكله لرزقكم كما يرزق الطير تغدوا خماصا ـ أي جائعة ـ وتروح بطانا
