The questioner : His final question states that a man performed Hajj with him last year, but he performed it as an individual (ifrad). After the tawaf and sa'y, he shaved his head following the example of the others. What is required of him? Does he remain as an individual, or is it permissible for him to shave and make it an 'Umrah? May Allah guide you?

The Shaykh : We say: It is better for him to make it an 'Umrah. Anyone who performs Hajj as an individual (ifrad) or in combination (qiran) and does not have a sacrificial animal (hady) should convert his state of ihram to 'Umrah so that he becomes one who performs tamattu'. This is what the Prophet (peace and blessings be upon him) ordered his Companions to do and made obligatory upon them. However, this man who shaved his head merely to follow the example of the others, while remaining with the intention of ifrad, should remain with the intention of ifrad. He will be considered an individual (mufrid) only. This shaving that occurred before he exited the state of ihram was done out of ignorance. If shaving is done by one in ihram out of ignorance, there is no sin upon him for it, and there is no expiation (kaffarah) required of him for it.

The questioner : Yes.

The Shaykh : Due to the generality of the saying of Allah the Exalted:
Our Lord, do not impose blame upon us if we have forgotten or erred. رَبَّنَا لا تُؤَاخِذْنَا إِنْ نَسِينَا أَوْ أَخْطَأْنَا
[Al-Baqarah 2:286]
.

The questioner : We received a message from the student Fadhil 'Abd al-Amir Nasser from the Iraqi Republic, Baghdad.
