The Shaykh : In the name of Allah, the Most Gracious, the Most Merciful. We have previously mentioned khushu' (humility) in prayer and its importance, and that prayer without khushu' is like a body without a soul.
We have previously discussed the details of this issue and the disagreement among scholars regarding it, so we will now begin explaining the hadith of Abu Hurayrah. He said:
Allah's Messenger (ﷺ) forbade keeping one's hands on one's waist while praying. نهى رسول الله صلى الله عليه وسلم أن يصلّي الرجل مختصرا
Bulugh al-Maram 2:105
We have previously defined the prohibition (naha) as a demand to refrain from an act with a sense of superiority, and we explained it as well. We also discussed whether the default ruling of a prohibition is prohibition (tahrim) or dislike (karahah), or if there is a detailed distinction in that matter?
He says:
forbade a man to perform prayer نهى أن يصلّي الرّجل
Sunan Ibn Majah 617Sahih (Darussalam)
The term "man" (al-rajul) is originally used for an adult male, just as "woman" (al-mar'ah) is used for an adult female, and it may also be used to refer simply to maleness or femaleness.
And his statement:
while standing with his hands on his hips. مختصرا
He explained it by saying its meaning is that one places his hand on his waist. The waist (khasar) is the area above the hip (haqwa); this area above the hip is called the waist. He provided the reason for this in the hadith in al-Bukhari from 'A'ishah, stating that this was the practice of the Jews. So, is his use of the word "man" a description for the purpose of exclusion, or do we say it is a title and not a description, and therefore does not indicate a concept? However, he attached the ruling to men based on the fact that most legal addresses are directed to men, because men bear greater responsibility than women. The second option is the correct one, so a woman is like a man in this matter.
