The questioner : It is said that there is a mosque in a village, and a while ago there was a grave in this mosque, built over with cement, reaching a height of half a meter, and some men and some women, when Friday evening came, would visit this grave and pour perfume over it, saying that it is a wali (close friend of Allah) from among the awliya (close friends of Allah). We tell them that this is haram (forbidden) and shirk (associating partners with Allah). After a period, they isolated the grave and what was in it to the side of the mosque, in a room next to the mosque, and placed the bones in that room, and they repaired the grave with cement to a height of half a meter and put an iron door on it. What is the ruling on their action? Please inform us, may Allah reward you with good?
The Shaykh : Mosques that contain graves are not free from two situations. The first situation is that the mosque precedes the grave, meaning the mosque was built and then a deceased person was buried in it after its construction. In this case, it is obligatory to dig up the grave and bury the deceased outside the mosque in the cemeteries. The second situation is that the grave precedes the mosque, meaning it was a grave and then a mosque was built over it. In this case, it is obligatory to demolish the mosque because it is haram (forbidden) in this situation, and what is haram (forbidden) is not permissible to leave in place, so the mosque must be demolished and the grave remains in its place. However, it is not permissible for the grave to remain as described by the questioner, raised, decorated, and built with cement, because this is from the exaltation of graves and their elevation. Ali said to Abu al-Hayyaj al-Asadi:Riyad as-Salihin 1687 Also, it is from what is wrong to pour perfume on it or place flowers on it or seek blessing from its soil or similar matters that are wrong and serve as a means to shirk (associating partners with Allah), for the means to matters are attached to their ends, meaning they become haram (forbidden) even if they do not equal them in the amount of sin and ruling, but there is no doubt that the means to the haram (forbidden) are haram (forbidden) and one must stay away from them.
