Q: There is a congregational mosque in our village, and this mosque is located in the middle of the cemeteries that surround it to the north and the south. The distance between it and the northern side is two meters, and likewise the southern side is two meters. Those cemeteries are in the process of expanding, and some of the worshippers—may Allah guide them—use those cemeteries as parking spaces for their cars. Inform us—may Allah reward you with all good—about the ruling in such a case, and we offer you our sincere thanks and appreciation.

A: There is no harm in the mentioned mosque remaining; because the custom is that people bury around the mosque, so that does not harm anything. The point is that burial around mosques is permissible, because it is easier for people; when they leave the mosque, they bury them around the mosque, so that does not harm anything and does not affect the prayer of the worshippers. However, if there are some graves in the qiblah of the mosque, the most cautious course is that there be a wall between the mosque and the cemetery, other than the wall of the mosque, or a road that separates them. This is the most cautious and preferable course; so that it is further from facing the graves.
As for if they are to the right of the mosque or to its left, meaning to the right of the worshippers or to their left, that does not harm them in any way; because they do not face them, because this is further from facing them and from the doubt of facing them.
As for parking cars, it is not permissible to park them on graves; rather, they should be parked away from the graves, on sound land that has no graves; because it is not permissible for people to desecrate graves, or for cars to be on graves. This is an abomination and is not permissible. It is obligatory that they move them away from the graves, and that they be in sound places that have no graves. If it is facilitated to enclose them with something that prevents passing through them and desecrating them, that is more cautious and safer; because the Muslim is respected in life and in death. For this reason, the Messenger of Allah (peace and blessings be upon him) forbade praying toward graves and sitting on them.
