Question: What is the legal ruling on the fasting of one who hears the Fajr adhan and continues to eat and drink?
Answer: It is obligatory for the believer to abstain from the things that break the fast, such as eating and drinking and others, when the dawn becomes clear to him, and the fast is obligatory, such as Ramadan, the fast of a vow, or expiation; because Allah (Glorified and Exalted is He) said: : [al-Baqarah:187]. So if he hears the adhan and knows that it is being called for the dawn, it is obligatory for him to abstain. If the mu'adhdhin is calling before the dawn rises, it is not obligatory for him to abstain, and it is permissible for him to eat and drink until the dawn becomes clear to him.
If he does not know the state of the mu'adhdhin, whether he called before the dawn or after the dawn, then the most preferable and safest course for him is to abstain when he hears the adhan. It does not harm him if he drinks or eats something at the time of the adhan; because he did not know of the rising of the dawn.
It is known that one who is inside cities with electric lights cannot know the exact time of the rising of the dawn, but he must be cautious by acting according to the adhan and the calendars that determine the rising of the dawn by the hour and minute, acting in accordance with the saying of the Prophet (peace and blessings be upon him):Sunan an-Nasa'i 5711Sahih (Darussalam), and his saying (peace and blessings be upon him): Bulugh al-Maram 16:32. And success is from Allah.
