Q1: I read in Tafsir al-Manar by the shaykh Rashid Rida , Volume One, where he states that the fasting person should abstain one-third of an hour before the Fajr adhan, that is, for a period of twenty minutes, and he calls this precautionary abstention. So,
what is the duration between abstaining and the Fajr adhan in Ramadan? What is the ruling on one who hears the mu'adhdhin saying "Prayer is better than sleep" and drinks as long as the adhan has not ended? Is it valid? What is the ruling on one who hears the mu'adhdhin calling the Fajr prayer and drinks? Is his fast valid or not? Some people sit on the kerb and smoke until the time of the adhan, then get up and drink, claiming that it is permissible. Some young men have told me that they hear me while I am calling the Fajr prayer and they get up to the water to drink. What is the ruling on one who does that intentionally?
A1: The basis for the fasting person's abstention and breaking his fast is the saying of Allah the Exalted:[Al-Baqarah 2:187] Eating and drinking are permissible until the dawn appears, which is the white thread that Allah has made the limit for the permissibility of eating and drinking. When the second dawn becomes clear, eating and drinking and other things that break the fast become forbidden. If one drinks while he is hearing the Fajr adhan, and the adhan is after the appearance of the second dawn, he must make up the fast. If it is before the appearance, he does not have to make it up. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
