Question: From 'Abd al-'Aziz ibn 'Abd Allah ibn Baz to the honorable brother A. M. (may Allah guide him), Amen.
Peace be upon you, and Allah’s mercy and blessings, and after that:
Your letter dated 24/4/1395 AH has been received, may Allah guide you. It contained the information that you had intercourse with your wife during the day in Ramadan, that she refused and you forced her, and that you are unsure whether it occurred on one day or two. You also stated that you are unable to free a slave or fast, and you requested a fatwa. This was known.

Answer: If the situation is as you described, then you must expiate for the intercourse on one day by feeding sixty poor people, giving each poor person half a sa' (a dry measure of about 3 kg) of the staple food of the land. If you feed them breakfast or dinner, that is sufficient. As for the intercourse on the day you are unsure about, nothing is obligatory for you regarding it, because the original state is the purity of one's conscience. However, if you expiate for it as a precaution, there is no harm. As for your wife, there is no expiation on her because she was forced. You must repent to Allah (Glorified and Exalted is He) from this reprehensible act. You must also make up the day on which the intercourse occurred.
We ask Allah to forgive us, you, and all Muslims. He is the best of those asked. And may peace and the mercy of Allah and His blessings be upon you.
